Minutes 72-11-20MINUTES OF AN AUJOURNED REGULAR MEETING OF THE CYPRESS CITY COUNCIL HELD November 20, 1972 An adjourned regular meeting of the Cypress City Council was called to order at 7:39 p.m., on Monday, November 20, 1972, in the Cypress City Council Chambers, 5275 Orange Avenue, Cypress, California, Mayor Otto Lacayo presiding. PRESENT: Councilmen Frankiewich, Harvey, Kanel, Roberts and Lacayo ABSENT: None Also present were Administrative Assistant Douglas Dunlap, City Attorney James Erickson and the following members of the City Staff: Davenport, Hawley, Nudson. Robertson and Schatzeder. PLEDGE OF ALLEGIANCE: Councilman Harvey led the City Council and audience in the Pledge of Allegiance. PUBLIC HEARING RE: CONSIDERATION OF THE PROPOSED ZONING ORDINANCE: The Mayor announced this was the time and place for the public hearing to consider an amendment to the Zoning Ordinance of the City of Cypress. It was decided to take up the other items on the agenda before entering discussion on the Zoning Ordinance. It was moved by Councilman Harvey, seconded by Councilman Roberrs and unanimously carried to continue the public hearing until 8:30 p.m. CONTINUATION OF CONSIDERATION OF RESCINDING THE CONTRACT FOR LEGAL PUBLICATION: The City Council reviewed a Staff report dated November 16, 1972, containing a comparison of the legal publication rates between the News Enterprise and the Buena Park News for the period of July 1, 1971 through June 30, 1972. Mr. Larry Collins, Publisher of the Buena Park News, addressed the City Council on the matter. Councilman Harvey said the matter was brought to the attention of the City Council by the Staff who indicated they were dissatisfied with the service rendered by the Buena Park News. Following discussion, it was moved by Councilman Roberrs and seconded by Councilwoman Frankiewich to instruct the City Manager to re-advertise for bids for legal publication for the balance of the fiscal year 1972-73 and to continue under the terms of the present contract until such time as new bids are received. Councilman Roberrs then stated that if the seconder of the motion would agree, he would withdraw the motion. Councilwoman Frankiewich sustained her second and the motion carried with the following roll call vote: AYES: NOES: ABSENT: COUNCILMEN: Frankiewich, Roberts and Lacayo COUNCILMEN: Harvey and Kanel COUNCILMEN: None CONTINUATION OF CONSIDERATION OF REVISED FLOOR PLANS AND ELEVATIONS FOR TRACT NO. 7892: The Planning Director reviewed a report dated November 9, 1972, stating the Planning Commission had approved the revised floor plans and building elevations submitted by the Larwin Company for Tentative Tract No. 7892. An Environmental Impact Statement had been submitted by Larwin and the Planning Commission found that the changes would have no adverse effect on the environment. As it was time to reopen the public hearing on the Zoning Ordinance, it was moved by Councilman Harvey, seconded by Mayor Lacayo and unanimously carried to table Item No. 3 on Tract No. 7892. TIlE:PROPOSED 'ZONING ORDINANCE: The Mayor reopened the public hearing~ It was moved by Councilman Harvey, seconded by Councilman Roberrs and unanimously carried to continue the public hearing on the Zoning Ordinance until the end of the agendao It was moved by Councilwoman Frankiewich, seconded by Councilman Harvey and unanimously carried to bring back Item No~ 3 on Tract Noo 7892 before the City Council. Discussion continued on the revised floor plans and building elevations submitted by Larwin Co~ Mr. Dee Anderson, representing the Larwin Co=,, 16255 Venture Blvd~, Encino, addressed the City Council on the matter~ It was moved by Councilman Kanel and seconded by Councilwoman Frankiewich to approve the revised floor plans and elevations for Tract No~ 7892 and to eliminate the condition of approval of wood shake roofs, and to require one 24" box tree at 40' on center along Valley View and Orangewood Streets in addition to the normal landscape requirements, with special wall treatment being provided along Valley View and Orangewood Streets subject to the specifications of the City Engineer and Planning Director. The motion carried with the following roll call vote: AYES: 5 COUNCILMEN: NOES: 0 COUNCILMEN: ABSENT: 0 COUNCILMEN: Frankiewich, Harvey, Kanel, Roberrs and Lacayo None None CONSIDERATION OF REPORT ON DKAINAGE PROBLEMS AT THE JOHN C~ LEAL DAIRY: The Administrative Assistant reviewed a staff report dated November 20, 1972, outlining a drainage problem on the Leal Dairy which is causing flooding of back yards of residences immediately west of the dairy~ It was moved by Councilman Harvey and seconded by Councilwoman Frankiewich to authorize the City Staff to work in conjunction with the State Water Quality Control Agency in solving the dairy drainage problems and direct the Staff to make a further progress report on Monday, November 27th, on this problem and to work with the City Atuorney to enforce the conditions of the existing judgment. Staff to include in November 27th progress report a recommendation as to how the City can approach the control of flies after the removal of the cows from the dairy and resolve the problem of drainageo The motion carried with the following roll call vote: AYES: 5 COUNCILMEN: NOES: 0 COUNCILMEN: ABSENT: 0 COUNCILMEN: Frankiewich, Harvey, Kanel, Roberrs and Lacayo None None RECESS: Mayor Lacayo declared a recess at 9:35 p~mo The meeting was called back to order at 9:47 p~mo, with all Councilmen present~ CONTINUATION OF PUBLIC HEARING RE: CONSIDERATION OF THE PROPOSED ZONING ORDINANCE: The Mayor opened the public hearing which had been continued from earlier in the evening on the proposed Zoning Ordinance° The Planning Director read a letter dated November 13, 1972, from Mr. William P. Rodgets of United Christian Fellowship, Po 01, Box 765, Cypress, requesting inclusion of convalescent homes in the RU Zonel. Mr. Joe Hardcastle, 4588 Blanca Drive, Cypress, addressed the City Council in opposition to allowing convalescent homes in residential zones. - 2- City Council Minutes November 20, 1972 Discussion continued on the proposed changes tothe Zoning Ordinance. The following people addressed the City Council in opposition to the proposed increase in squarefootage required for multiple dwellings: Mr. Daniel J. Barrett, 526 Parkwood, Anaheim Mr. Don Clark, 18740 Venture Boulevard, Tarzana Mr. Leland Minor, 384 N~ Shattuck Place, Orange Mr~ Joe Hardcastle, 4588 Blanca Drive, Cypress, addressed the City Council and spoke in favor of the increase in square footage.
