Minutes 2000-08-21MINUTES OF A SPECIAL MEETING OF THE CYPRESS CITY COUNCIL HELD AUGUST 21, 2000 A special meeting of the Cypress City Council was called to order at 5:13 p.m. by Mayor Piercy in the Board Room, West Wing of City Hall, 5275 Orange Avenue, Cypress, California. PRESENT: Council Members Keenan, Sondhi, and Mayor Piercy ABSENT: Council Member McCoy, Mayor Pro Tem McGill Also present were City Manager Importuna and City Attorney Wynder. NEW BUSINESS: APPOINTMENT OF TWO (2) CANDIDATES TO THE OFFICE OF CITY COUNCIL MEMBER, OR DIRECT AN ELECTION TO BE HELD ON TUESDAY, NOVEMBER 7., 2000, PURSUANT TO § 10229 OF THE ELECTIONS CODE OF THE STATE OF CALIFORNIA. City Attorney Wynder discussed two alternative Resolutions which the Council is authorized to consider and act upon. The Council was briefed by the City Attorney at the August 14, 2000, regular City Council meeting that § 10229 of the Elections Code of the State of California provides that if there are only two candidates nominated to fill two offices to be elected, the Council has the option of either appointing the two nominated individuals to office to fill the prospective term(s), or direct an election to be held, as presently scheduled for Tuesday, November 7, 2000. However, if the Council were to direct an election to be held, the City would incur the costs of conducting the election. There are two alternative Resolutions included in the staff report; one of which appoints Council Member Keenan and Mayor Piercy to the offices to which they were nominated and to take office and serve exactly as if elected at a municipal election for office; the second which directs the election to be held as scheduled on November 7, 2000. The City Attorney stated that the Council must adopt one of these two Resolutions, which would support one of the two alternative courses of action discussed above that the Council decided to take, pursuant to § 10229 of the Elections Code of the State of California. CITY COUNCIL MINUTES AUGUST 21, 2000 Mayor Piercy stated that a Cypress citizen commented to her that he hoped the City Council would save the taxpayers' money by not holding an election, and appoint Council Member Keenan and Mayor Piercy to office. It was moved by Council Member Sondhi and seconded by Council Member Keenan to appoint Council Member Keenan and Mayor Piercy to the offices to which they were nominated, pursuant to § 10229 of the Elections Code of the State of California, and cancel the election scheduled to be held on Tuesday, November 7, 2000, and adopt a Resolution providing for the appointment to the office(s) of this City that were to be elected on Tuesday, November 7, 2000. The motion carried by the following roll call vote: AYES: 3 COUNCILMEMBERS: Keenan, Sondhi, and Piercy NOES: 0 COUNCILMEMBERS: None ABSENT: 2 COUNCILMEMBERS: McCoy, McGill RESOLUTION NO. 5290 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS, CALIFORNIA, PROVIDING FOR THE APPOINTMENT TO THE OFFICE(S) OF THIS CITY THAT WERE TO BE ELECTED ON TUESDAY, NOVEMBER 7, 2000 ORAL COMMUNICATIONS: Kathy Scott, News - Enterprise, reported that Cypress photographer Martin Figoten passed away. Mayor Piercy stated that she is elated with the vote of confidence from the community, as evidenced by the fact that there were no additional candidate filers, other than Council Member Keenan and Mayor Piercy. She stated that it illustrates the cohesiveness and cooperation of the current City Council, and she is looking forward to serving for four additional years. ADJOURNMENT: Mayor Piercy adjourned the meeting at 5:19 p.m. to Monday, August 28, 2000, at 5:30 p.m. in the Board Room, West Wing of City Hall, 5275 Orange Avenue, Cypress, California.
