Minutes 2012-07-30392 MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CYPRESS CITY COUNCIL HELD July 30, 2012 An adjourned regular meeting of the Cypress City Council was called to order at 5:31 p.m. by Mayor Bailey in the Executive Board Room, 5275 Orange Avenue, Cypress, California. Members present: Mayor Doug Bailey Mayor Pro Tem Prakash Narain Council Member Leroy Mills Council Member Todd Seymore Members absent: Council Member Phil Luebben Staff present: City Manager John Bahorski City Clerk Denise Basham ORAL COMMUNICATIONS: None. NEW BUSINESS: Item No. 1: ADOPTION OF RESOLUTIONS FOR A BALLOT MEASURE FOR THE GENERAL MUNICIPAL ELECTION OF NOVEMBER 6, 2012 Jack Rubens, Los Alamitos Race Track counsel, thanked the City Council for continuing this matter to August 9, 2012. He indicated that he spent this afternoon at the office of the O.C. Registrar of Voters and that the results are inconclusive because he was unable to compare the petition signatures to the computer signatures. Mr. Rubens indicated that the signature verification is done both manually and computerized, and that the O.C. Registrar of Voters disqualified 1,726 of the 3,800 signatures received. He stated that there are six signature gatherers who had a rate of over 50% invalid signatures and that he would be proposing to the O.C. Registrar of Voters that an expert be allowed to look at the digitized signatures. Mr. Rubens stated that he would be proposing a critical path schedule in order to show that 1,000 of the 1,700 signatures are verified by August 9, 2012, as approximately 2,800 verified signatures are needed. Council Member Seymore asked if more signatures could be gathered. Mr. Rubens responded that the signature gathering period has concluded, as the petitions can only be submitted to the O.C. Registrar of Voters once. Council Member Mills asked if the same signature gathering company was hired as with Measure L. Mr. Rubens indicated that it was the same signature gathering company, however, some of the signature gatherers were different and that it was a reputable company. Mayor Pro Tem Narain asked about the appeal process. Mr. Rubens stated that he is unsure of the formal appeal process. Mayor Bailey asked if only one person is reviewing the signatures. It was moved by Council Member Seymore and seconded by Mayor Pro Tem Narain, that the City Council continue this item to an adjourned regular meeting of August 9, 2012, beginning at 5:30 p.m. The motion was carried by the following roll call vote: AYES: 4 COUNCIL MEMBERS: Mills, Seymore, Narain and Bailey NOES: 0 COUNCIL MEMBERS: None ABSENT: 1 COUNCIL MEMBERS: Luebben ADJOURNMENT: Mayor Bailey adjourned the meeting at 5:46 p.m. to Thursday, August 9, 2012, beginning at 5:30 p.m. in the Executive Board Room.
