ORDINANCE NO. 1131
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS
ADOPTING ZONING ORDINANCE AMENDMENT NO. 2011 -02
TO MODIFY SECTIONS 4.19.060.H.2, 4.19.070.H.3, AND 4.19.080.1.2
OF THE CYPRESS ZONING CODE.
WHEREAS, the duly noticed public hearing for the consideration of the zoning
code amendment was held by the City Council of the City of Cypress on January 9, 2012;
and
WHEREAS, the City Council of the City of Cypress has considered evidence
presented by the City staff and other interested parties at the public hearing held with
respect thereto.
NOW, THEREFORE, the City Council of the City of Cypress hereby finds that:
SECTION 1: Sections 4.19.060.H.2 of the Cypress Zoning Code is hereby
amended in part to read as follows:
Sec. 4.19.060. Design Review Committee Permits
H. Time limit for using design review approval
2. A design review approval subject to lapse may be renewed for
additional twelve month periods, not to exceed three (3) extensions by
the Director of Community Development (appealable to the City Council)
as necessary. Any further extensions beyond that period may be
requested but will be subject to City Council approval; provided, the
application for renewal is filed with the department before the expiration
date.
SECTION 2: Section 4.19.070.H.3 of the Cypress Zoning Code is hereby
amended in part to read as follows:
Sec. 4.19.070. Conditional Use Permits
H. Time limit for conditional use permits
3. A conditional use permit may be extended for additional
twelve month periods, not to exceed three (3) extensions by the Director
of Community Development (appealable to the City Council) as
necessary. Any further extensions beyond that period may be
requested but will be subject to City Council approval; provided, the
application for extension is filed with the department at least fourteen
(14) days before the expiration date.
SECTION 3: Sections 4.19.080.1.2 of the Cypress Zoning Code is hereby
amended in part to read as follows:
Sec. 4.19.080. Variances
1. Time limit for implementing a variance
2. A variance may be extended for additional twelve month
periods, not to exceed three (3) extensions by the Director of
Community Development (appealable to the City Council) as necessary.
Any further extensions beyond that period may be requested but
will be subject to City Council approval; provided, the application for
extension is filed with the department at least fourteen (14) days before
the expiration date.

The Zoning Code Amendment as approved is consistent with the General Plan of the City
of Cypress.
SECTION 4: The categories for Design Review Committee Permits, Conditional
Use Permits, and Variances have been amended to allow development project approvals
to be extended due to extenuating circumstances or changes in the economy which may
impact the feasibility of constructing the project in a one (1) year period.
SECTION 5: The City Clerk is hereby authorized and directed to certify as to the
passage of this Ordinance and to give notice thereof by causing copies of this Ordinance
to be posted in three (3) public places throughout the City.
FIRST READING at a regular meeting of the City Council of said City held on the
9th day of January, 2012 and finally adopted and order posted at a regular meeting held
on the 23rd day of January, 2012.
