Ordinance No. 1102469 ORDINANCE NO. 1102 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS, CALIFORNIA, AMENDING SECTION 21A -19 OF THE CYPRESS MUNICIPAL CODE REVISING THE FORMAL BID LIMIT FOR PUBLIC WORKS PROJECTS. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CYPRESS DOES FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1. Sec 21A-19 of Chapter 21A, "Purchasing System," of the code of the City of Cypress, is hereby amended to read as follows: Sec. 21A-19. Contracts for public works. Every project involving an expenditure of more than one hundred thousand dollars ) ($100,000) for the construction, improvement, repair, or maintenance of public works shall be let in accordance with the procedures set forth in the Charter of the City of Cypress. Such projects involving an expenditure of twenty- five thousand one hundred thousand dollars ($25000.00) ($100,000) or less may be affected by the use of city forces or let through informal bid procedures applicable to the purchase of supplies and equipment. For Professional Services Contracts under fifty thousand dollars ($50,000) related to Public Works Projects, the City Manager is authorized to enter into contract. Contracts in excess of fifty thousands dollars ($50,000) shall be approved by City Council. These limits shall be updated annually before July 1 of each year, based on the cost index for construction costs in Los Angeles area as published by ENGINEERING NEWS- RECORD, New York, New York, by resolution of City Council. Section 2. If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this ordinance, or any part thereof is for any reason held to be unconstitutional or invalid or ineffective by any court of competent jurisdiction, such decision shall not affect the validity or effectiveness of the remaining portions of this article or any part thereof. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase of this article irrespective of the fact that one or more sections, subsections, subdivisions, paragraphs, sentences, clauses or phrases be declared unconstitutional or invalid or ineffective. To this end the provisions of this article are declared to be severable.
