ORDINANCE NO. 1100
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS,
CALIFORNIA, ADOPTING AN AMENDMENT TO SECTIONS V.E.1.a , V.E.1.b,
V.E.4.b.1, VII.C.2.a, AND EXHIBITS 10 AND 14 OF THE CYPRESS BUSINESS &
PROFESSIONAL CENTER SPECIFIC PLAN, AMENDING BUILDING AND LOADING
AREA SETBACKS, SIGNAGE, AND LANDSCAPE CRITERIA, RESPECTIVELY.
WHEREAS, a duly noticed public hearing for this consideration of these specific
plan amendments was held by the City Council of the City of Cypress on the 28th day of
April, 2008; and
WHEREAS, the City Council of the City of Cypress considered evidence presented
at the public hearing including a staff report and public testimony; and
NOW, THEREFORE, the City Council of the City of Cypress hereby ordain as
follows:
SECTION 1: The amendment to the Cypress Business & Professional Center
Specific Plan would hereby modify the Katella Avenue building setback for buildings in
Planning Areas 5 and 6 of the Specific Plan area, which are less than forty -five feet (45') in
height from forty feet (40') to twenty -five feet (25'). This amendment will be reflected within
the Cypress Business & Professional Center Specific Plan with the following text addition
(shown in bold type below) to page V -5;
V.E.1.a.1) "AII buildings less than or equal to forty -five feet (45') in height shall have a
minimum met twenty -five (25) foot setback."
SECTION 2: The amendment to the Cypress Business & Professional Center
Specific Plan would hereby modify the building setback for Katella Avenue from forty feet
(40') to twenty -five feet (25'). This amendment will be reflected within the Cypress
Business & Professional Center Specific Plan with the following text addition (shown in
bold type below) to page V -5;
V.E.1.b. "Katella and—Gar-cites Avenue shall have a minimum front and street side
yard building setback of 25 feet. The first 20 feet and the
of the 40-feet 25 foot building setback, shall
be landscaped per Section VII herein. Cerritos Avenue shall have a
minimum 40 foot building setback with the first 20 feet landscaped per
Section VII herein."
SECTION 3: The amendment to the Cypress Business & Professional Center
Specific Plan would hereby reduce the distance requirement for loading areas from
property lines from one hundred feet (100') to forty feet (40') from all property lines. This
amendment will be reflected within the Cypress Business & Professional Center Specific
Plan with the following text addition (shown in bold type below) to page V -6;
V.E.4.b.1. "Any loading facility shall be setback a minimum of forty feet (40') eras
hundred feet (100') from the property line ".
SECTION 4: The amendments to the Cypress Business & Professional Center
Specific Plan would hereby modify the building wall sign criteria to eliminate the maximum
150 square feet sign area requirement for wall signs. This amendment will be reflected
within the Cypress Business & Professional Center Specific Plan with the following text
deletion (shown in strike -out type below) to page VII -7;
VII.C.2.a "No wall sign will exceed an area equal to one and one half (1 -1/2) square
feet of sign for each one foot (1') of lineal frontage of the building or store,
fronting on a street or parking lot. No sign shall
aroa nor comprise more than ten percent (10 %) of the area of the
elevation upon which the sign is located."

SECTION 5: The amendments to the Cypress Business & Professional Center
Specific Plan would hereby modify Section VII.D, Landscape /Streetscape Guidelines, of
the Specific Plan as follows; 1) the location of the right -of -way line on the east side of the
Major Entry at Katella Avenue shown on Exhibit 10 shall be shifted approximately thirty -
four feet (34') east of the location currently shown on the Exhibit, and 2) the Katella
Avenue Streetscape illustrated on Exhibit 14 would be modified to reflect the reduced
landscape setback along Katella Avenue from thirty feet (30') to twenty feet (20'). In
addition, the text of Section VII.D.3 would be modified to reflect the reduced landscape
setback of twenty feet (20').
SECTION 6: The Amendments to the Cypress Business & Professional Center
Specific Plan would not increase the allowable building density or modify the types of
land uses assumed in the environmental analysis of the Specific Plan.
SECTION 7: Development projects subject to the amended provision would be
analyzed for compliance with the California Environmental Quality Act (CEQA) on a
project by project basis; and
SECTION 8: The proposed amendments have been reviewed and found to be
consistent with the goals and objectives of the Cypress General Plan.
SECTION 9: The City Clerk of the City of Cypress shall certify to the passage and
adoption of this ordinance and the same shall be posted as required by law and shall take
effect as provided by law.
FIRST READING at a regular meeting of the City Council of said City held on the
28th day of April, 2008 and finally adopted and order posted at a regular meeting held on
the 12th day May, 2008. /A ,
