Ordinance No. 1098458 ORDINANCE NO. 1098 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS, AND THE EX OFFICIO GOVERNING BODY OF THE CYPRESS RECREATION & PARK DISTRICT, AMENDING CHAPTER 13 ARTICLE IV, SECTION 13 -21, RELATED TO IMPLEMENTATION OF THE FEDERAL CLEAN WATER ACT WHEREAS, City Council originally adopted the Cypress Water Quality Ordinance on January 9, 1995, to provide enforcement of a municipal water quality program and in conformance to the Federal clean water statutory requirements; and WHEREAS, upon the adoption of the NPDES Third Term Permit new requirements were imposed upon cities within the Santa Ana Region as relates to permitted discharges into the municipal storm drain system; and WHEREAS, with the new Permit in effect, the City Council has determined that the Cypress Water Quality Ordinance should be amended to coincide with the requirements of the NPDES Permit; and WHEREAS, in order to create consistency of this action within the City's Municipal Code, it is necessary to amend Chapter 13, Article IV, Section 13 -21 to remove reference to domestic sanitary sewage discharge exception to be effective thirty days after adoption of this ordinance; and NOW, THEREFORE, the City Council of the City of Cypress, California, does hereby ordain as follows: SECTION 1. Chapter 13, Article IV, Section 13 -21, of the Cypress Municipal Code is hereby amended, in its entirety, to read as follows (strike- through shows deleted text, underlining shows new text): "Section 13 -21. Definitions. a aro oxcoptions to this articlo and oxcludod from tho dofinition of sanitary wastes (commonly callod domestic sewage) and other aro within publicly ownod wastewator troatment system Prohibited discharge shall mean any discharge, which is not composed entirely of stormwater or which contains any pollutant, from public or private property to: (i) the stormwater drainage system; (ii) any upstream flow, which is tributary to the stormwater drainage system; (iii) any groundwater, river, stream, creek, wash or dry weather arroyo, wetlands area, march, coastal slough; or (iv) any coastal harbor, bay, or the Pacific Ocean. The term "prohibited discharge" shall not include: (a) Discharges occurring in compliance with the NPDES permit, (b) discharges occurring pursuant to a state general permit or other regional water quality control board, state water resources control board or U.S. Environmental Protection Agency issued NPDES permit or permit waiver, (c) discharges authorized pursuant to a permit issued under section 13 -29 hereof. (Discharges allowable under the discharge exception), or (e) FIRST READ at a regular meeting of the City Council of said City held on the 10th day of December, 2007, and finally adopted and order posted at a regj,lar meeting held on the 14th day of January, 2008.
