Ordinance No. 1045ORDINANCE NO. 1045 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS, ADOPTING THE THIRD AMENDMENT TO THE REDEVELOPMENT PLAN FOR THE LINCOLN AVENUE REDEVELOPMENT PROJECT PURSUANT TO SENATE BILL 211 AS CODIFIED IN HEALTH AND SAFETY CODE SECTION 33333.6(e)(2) THE CITY COUNCIL OF THE CITY OF CYPRESS DOES ORDAIN AS FOLLOWS: SECTION 1. The City Council of the City of Cypress previously adopted the Redevelopment Plan for the Lincoln Avenue Redevelopment Project by Ordinance No. 852 adopted on June 25, 1990 ( "Original Plan "), as amended by Ordinance No. 932 adopted on January 9, 1995 ( "First Amendment "), and by Ordinance No. 1013 adopted on August 27, 2001 ( "Second Amendment ") (the Original Plan as amended by the First Amendment, and Second Amendment, is hereinafter collectively referred to as the "Plan "). SECTION 2. The Plan is hereby amended to delete from the Plan any and all time limits stated in the Plan that purport to place on the Cypress Redevelopment Agency any time deadline on the establishment of loans, advances, and indebtedness with respect to the Plan or the redevelopment project area delineated in the Plan (hereinafter, the "Third Amendment "). SECTION 3. This Third Amendment to the Plan is effected pursuant to the authority established by Senate Bill 211, effective January 1, 2002, which is codified in pertinent part in Health and Safety Code Section 33333.6(e)(2), which states in pertinent part: "On or after January 1, 2002, a redevelopment plan may be amended by a legislative body by adoption of an ordinance to eliminate the time limit on the establishment of loans, advances, and indebtedness required by this section prior to January 1, 2002. In adopting this ordinance, neither the legislative body nor the agency is required to comply with [Health and Safety Code] Section 33354.6 or Article 12 (commencing with Section 33450) or any other provision of this part relating to the amendment of redevelopment plans, except that the agency shall make the payment to affected taxing agencies required by [Health and Safety Code] Section 33607.7." SECTION 4. The City of Cypress hereby elects to receive its allocation of Tax Increment revenue pursuant to the provisions of Health and Safety Code Sections 33607.7 and 33607.5. SECTION 5. Except as amended hereby, the Plan shall remain in full force and effect according to its terms. SECTION 6. All required proceedings and considerations precedent to the adoption of this Ordinance have been regularly taken in accordance with applicable law. SECTION 7. The City Manager or authorized designee shall notify the appropriate public officials and public entities of the adoption of this Ordinance if and as required by law. SECTION 8. The City Clerk shall certify to the passage of this Ordinance and shall cause this Ordinance or a summary thereof to be published as required by law.
