Ordinance No. 1027134 ORDINANCE NO. 1027 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS, CALIFORNIA, AMENDING CHAPTER 16, ARTICLE XVII, OF THE CODE OF THE CITY OF CYPRESS RELATING TO CYPRESS TRANSPORTATION DEMAND MANAGEMENT REQUIREMENTS FOR SPECIFIED NEW DEVELOPMENT PROJECTS. WHEREAS, the City Council of the City of Cypress recognizes the significance of establishing county -wide congestion management programs that are intended to address traffic congestion and protect air quality; and WHEREAS, to comply with regulations established by AB 1791, Proposition 111, and Measure M, the City Council of the City of Cypress adopted Transportation Demand Management (TDM) Requirements for Specified New Development Projects in April 1991; and WHEREAS, the Transportation Demand Management Ordinance adopted in April 1991 established an employee threshold of 100 employees, in conformance with the South Coast Air Quality Management District's Regulation XV, that determined when the requirements would be applicable; and WHEREAS, Rule 2202 was recently adopted by the South Coast Air Quality Management District, which superceded Regulation XV, raising the employee threshold to 250 employees; and WHEREAS, the County of Orange Growth Management Program requires that the City of Cypress's current TDM ordinance be amended to reflect the new threshold and other language modifications to remain eligible for future Measure M Turnback funds. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CYPRESS DOES FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 16 -100 (d): Findings and Determinations, of the Cypress Municipal Code is hereby amended as follows: Other transportation demand management (TDM) program requirements have been adopted for the region including Regulation XV Rule 2202 and Appendix IV G Appendix IV -B Transportation Control Measures of the air quality management plan (AQMP). Section 16 -102 (a): Goals and Objectives, of the Cypress Municipal Code is hereby amended as follows: The goal of the transportation demand management program is to minimize the potential impact of new commercial, industrial, and mixed -use development including employment centers of ono hundred (100} two hundred fifty (250) persons upon existing transportation and parking facilities, resulting in increased motor vehicle emissions, deteriorating levels of service, and possibly significant additional capital expenditures to augment and improve the existing transportation system. Section 16 -103: Definitions, of the Cypress Municipal Code is hereby amended as follows: Employee shall mean any person employed by a firm, person(s), business, educational institution, nonprofit agency or corporation, government agency or other entity which employs mad- (100) two hundred fifty (250) or more persons at a single worksite. Employer means any person(s) firm, business, educational institution, government agency, non profit agency or corporation, or other entity which employs ene- hun00) two hundred fifty (250) or more persons at a single worksite - - - - - - - - - - -, and may either be a property owner or tenant of an applicable development project. Peak Period means those hours of the business day between 6:00 a.m. and 10:00 a.m., Monday through Friday. Worksite shall mean a building or group of buildings which are in actual physical contact or separated solely by a private or public roadway or other private or public right -of -way, and which are owned or operated by the same employer (or employers under common control). Section 16 -104 (a): Objectives, of the Cypress Municipal Code is hereby amended as follows: All new development projects, commercial, industrial, institutional, or other uses which are determined to employ 1-00} two hundred fifty (250) or more persons including any permit for expanding or changing the use of existing facilities that already have I00} two hundred fifty (250) or more employees or will have one hundred (100) two hundred fifty (250) or more employees as determined by the employee generation factors specified under this section shall be subject to this section. Section 104 (b)(2): Objectives, of the Cypress Municipal Code is hereby amended as follows: Building sizes shall be considered equivalent to the -ed(1 -00} two hundred fifty (250) employee threshold as follows: Section 16 -105 (2)(b): Facility Standards, of the Cypress Municipal Code is hereby amended as follows: Shower and locker room facility for employees of each sex shall be provided in each building housing one hundred { 00) two hundred fifty (250) or more employees.
