RESOLUTION NO. 6244
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
AUTHORIZING DOGS TO BE UPON CERTAIN PUBLIC SPACES
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY RESOLVES,
DETERMINES, AND ORDERS AS FOLLOWS THAT:
WHEREAS, pursuant Cypress Municipal Code, Chapter 3 ( "Animal and Fowl "),
Section 3 -1.1, the City Council amended certain provisions of the Orange County Code of
Ordinances relating to the possession and restraint of vicious and potentially dangerous
dogs in the City of Cypress; and
WHEREAS, as amended, the Orange County Code of Ordinances Section 4 -1 -46
provides as follows:
No person having the charge of any dog, except a blind,
deaf or disabled person with his or her guide dog, signal
dog or service dog, or a person training a guide, signal
or service dog, shall permit said dog to be under any
circumstances within public school property, City of
Cypress parks, or any building owned or occupied
by the City.
Exceptions. The provisions of this section are not
applicable to dogs- Police service K -9s and "guide
dogs" or in areas designated by the City Council as
allowing dogs. In the event the City Council, by
resolution, authorizes dogs to be upon any public space,
the provisions of this section shall not be applicable
thereto.
The terms "guide dog," "service dog," and "signal dog,"
in this section shall be given the same meaning as set
forth in Penal Code Section 365.5.
WHEREAS, pursuant to the express authority set forth in this amended section 4 -1-
46, the City Council now desires to designate certain "public spaces" as authorized for dogs,
upon the terms, conditions and restrictions set forth below in this Resolution.
NOW, THEREFORE, BE IT RESOLVED THAT the City Council of the City of Cypress
hereby designates as follows:
Section 1. The foregoing recitals are true and correct and are hereby incorporated
within this Resolution.
Section 2. The City Council of the City of Cypress hereby authorizes dogs to be in
or upon green grassy areas in all City parks authorized for dogs, subject to the
following restrictions:
(1) At all times that the dog and dog owner or handler are within these
designated public spaces of the City of Cypress, the dog must be kept on a leash not
to exceed six (6) feet in length. Failure to properly exercise due care by securing
his /her dog in accordance with this restriction shall subject the dog owner or handler to
fines as provided by Cypress Municipal Code, Chapter 1, Section 1 -7.
(2) At all times that the dog and dog owner or handler are within these
designated public spaces of the City of Cypress, the dog owner or handler having
custody of the dog shall immediately remove all feces deposited by such dog. Failure
to comply with this restriction shall subject the dog owner or handler to the
assessment of penalty fees as provided by the Cypress Municipal Code, Chapter 1,
Section 1 -7.
