Ordinance No. 6311 ORDINANCE NO. 631 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS REPEALING ARTICLES IV, VII, VIII AND IX OF CHAPTER 2 AND SECTIONS 16 -8 THROUGH 16 -10.1, INCLUSIVE, AND AMENDING SECTION 2 -49 OF THE CYPRESS CITY CODE RELATING TO VARIOUS COMMISSIONS AND DESIGNATING ITSELF AS THE PLANNING AGENCY FOR SAID CITY. THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY DOES ORDAIN AS FOLLOWS: SECTION 1. Articles IV, VII, VIII and IX of Chapter 2 and Section 16 -8 through 16 -10.1, inclusive, of the Cypress City Code hereby are repealed in their entirety. SECTION 2. Section 2 -49 of the Cypress City Code hereby is amended to read as follows: Sec. 2 -49. Duties. The recreation and parks commission shall advise the city council on all matters subject to the jurisdiction of the council pertaining to the acquisition, develop- ment and maintenance of public parks and recre- ational facilities as well as facilities and programs relating to artistic and cultural activities within the community. The commission shall also review and advise the council regarding the financing of and budgeting for such functions, including but not limited to, the financing and budgeting of any subsidiary district of the city. The commission shall also advise the recreation and parks director from time to time. SECTION 3. The City Council hereby designates itself as the planning agency for the City of Cypress pursuant to the provisions of Government Code Section 65100. SECTION 4. Wherever a provision of the Cypress City Code or of the Zoning Ordinance of the City of Cypress refers to the Planning Commission, the Industrial and Commerical Development Commission, the Youth Commission and /or the Traffic Commission, said reference shall be deemed and construed to be to the City Council. Wherever a provision of the Cypress City Code or of the Zoning Ordinance of the City of Cypress refers to the Arts and Cultural Commission, said reference shall be deemed and construed to be to the Recreation and Parks Commission. SECTION 5. It is the intention of the City Council that the Recreation and Parks Commission and the Arts and Cultural Commission be combined into one commission to be known as the Recreation and Parks Commission. For the purposes of determining the seven voting members of said Recreation and Parks Commission, the individuals who served on the Arts and Cultural Commission 2 immediately prior to the effective date of this ordinance hereby are authorized and requested to select three of their members to serve on said Recreation and Parks Commission and to notify the City Council of the names of the members so selected. The individuals who held office on the Recreation and Parks Com- mission immediately prior to the effective date of this ordinance hereby are authorized and requested to select four of their members to serve on said Recreation and Parks Commission and to notify the City Council of the names of said members. The seven individuals so selected (or, in the absence of such a selection, seven individuals to be designated by the City Council) will constitute the initial membership of the Recreation and Parks Commission. The terms of office of the members so selected shall be deemed to have commenced as of the date upon which they were first appointed to either the Arts and Cultural Commission or the Recreation and Parks Com- mission, except as otherwise provided by Section 1 of Ordinance No. 547. SECTION 6. Unless and until otherwise so provided by resolution of this City Council the members of the Recreation and Parks Commission shall serve without compensation. SECTION 7. If any section, subsection, subdivision, sentence, clause, phrase, or portion of this ordinance, or the application thereof to any person or place, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance or its application to other persons or places. The City Council hereby declares that it would have adopted this ordinance, and each section, subsection, subdivision, sentence, clause, phrase or portion thereof, irrespective of the fact that any one or more subsections, subdivisions, sentences, clauses, phrases, or portions, or the application thereof to any person or place, be declared invalid or unconstitutional. SECTION 8. The City Clerk hereby is authorized and directed to certify as to the passage of this ordinance and to give notice thereof by causing copies of this ordinance to be posted in three public places within the City. FIRST READ at a regular meeting of the City Council of said City held on the llth day of September 1978, and finally adopted and ordered posted at a regular meeting of said Council held on the 25th day of September 1978.
