RESOLUTION NO. 3817
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CYPRESS SETTING COMPENSATION AND
EXPENSES FOR MEMBERS OF THE COMMUNITY
REDEVELOPMENT AGENCY OF THE CITY OF
CYPRESS PURSUANT TO HEALTH AND SAFETY
CODE SECTIONS 33114 AND 33114.5
WHEREAS, the City of Cypress has activated its
Community Redevelopment Agency pursuant to State law; and,
WHEREAS, the City Council of the City of Cypress
serves as the Agency Board for the Community Redevelopment
Agency of the City of Cypress; and,
WHEREAS, Agency Members regularly and historically
incur expenses in the discharge of their duties; and,
WHEREAS, said expenses have been in the forty
dollar ($40.00) per month range; and,
WHEREAS, the cost of accounting, recording keeping,
and auditing for such expenses would likely exceed the forty
dollar ($40.00) per month reimbursement for expenses; and,
WHEREAS, Health and Safety Code Section 33114
authorizes Agency Members to receive compensation and
reimbursement for actual and necessary expenses in
discharging their duties; and,
WHEREAS, Health and Safety Code Section 33114.5
provides that where the legislative body of the local agency
declares itself to be the Agency pursuant to Health and
Safety Code Section 33200 that compensation shall not exceed
thirty dollars ($30.00) per meeting attended, not to exceed
four meetings per month.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
CYPRESS DOES HEREBY RESOLVE, DETERMINE, ORDER AND FIND AS
FOLLOWS:
SECTION 1. That the City Council hereby sets
compensation for the Members of the Community Redevelopment
Agency of the City of Cypress at thirty dollars ($30,00) per
meeting attended, not to exceed four meetings per month in
accordance with Health and Safety Code Section 33114.5.
SECTION 2. That the City Council declares and sets
pursuant to Health and Safety Code Section 33114 the sum of
forty dollars ($40.00) per month which shall constitute
reimbursement to Members of the Community Redevelopment
Agency of the City of Cypress for actual and necessary
expenses incurred in the discharge of their duties.
SECTION 3. That the City Council finds that the
direct reimbursement of said forty dollar ($40.00) sum is
the most economical method of providing reimbursement to
Members of the Agency in light of accounting, record -
keeping, and auditing costs.
SECTION 4. That this Resolution shall be effective
as of January 1, 1990.
PASSED AND ADOPTED by the City Council of the City
of Cypress at a regular meeting held on the 27th day
of August , 1990.
