Resolution No. 6172 116 RESOLUTION NO. 6172 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS REQUESTING THAT THE GOVERNOR CANCEL THE PROPOSED SALE OF THE ORANGE COUNTY FAIRGROUNDS WHEREAS, The Orange County Fairgrounds is a major entertainment, recreational, cultural and educational asset to Orange County with over 100 events held there annually supporting cultural and non-profit organizations; and WHEREAS, as a result of the State of California's budget deficit of over $26 billion, the largest in the state's history, Governor Arnold Schwarzenegger proposed the sale of surplus or underutilized assets for the purpose of helping to close the budget deficit; and WHEREAS, on July 28, 2009 the Orange County Board of Supervisors adopted Resolution # 09-110, in support of Governor Schwarzenegger's proposal to sell the Orange County Fairgrounds, only if the sale provided that the Fairgrounds would be sold to a local government agency or local not-for-profit corporation to perpetuate its use as a fairgrounds, event center, and equestrian facility; and WHEREAS, on October 7, 2009, the California Department of General Services released a Request for Proposals for the sale of the Orange County Fairgrounds; and WHEREAS, the Request for Proposals does not require the buyer to be a local government agency or local not-for-profit, nor does it require the buyer to perpetuate the utilization of the property as a fairgrounds, event center, and equestrian facility; and WHEREAS, on November 24, 2009, the Orange County Board of Supervisors adopted Resolution #09-180, requesting that the Governor immediately cancel the proposed sale of the Orange County Fairgrounds, and called upon all other cities in Orange County to join with the County of Orange and the City of Costa Mesa in formally requesting the Governor to cancel the proposed sale of the Orange County Fairgrounds immediately. WHEREAS, the Orange County Fairgrounds is the only asset of its kind the State is actually proposing to sell and relinquish control over; and WHEREAS, the Orange County Fairgrounds are wholly contained within the corporate limits of the City of Costa Mesa; the City of Costa Mesa's General Plan designates the property as "Fairgrounds"; the City of Costa Mesa has zoned the property "recreational/institutional"; and WHEREAS, the Costa Mesa City Council has authorized preparation of a Specific Plan for the Fairgrounds property and subsequently directed staff to prepare a ballot initiative for the June 2010 ballot for voter approval of a land use restriction to "Fairgrounds"; and WHEREAS, the Orange County Board of Supervisors believes that it is in the best interest of the public that the Governor immediately cancel the sale of Fairgrounds property. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Cypress does hereby support and join the Orange County Board of Supervisors, the City of Costa Mesa, and all other cities in Orange County in formally requesting the Governor to cancel the proposed sale of the Orange County Fairgrounds immediately. MAY R OF THE CITY OF CYPRE S 118 RESOLUTION NO. 6173 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING CONDITIONAL USE PERMIT NO. 2008-03 - WITH CONDITIONS. THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS: 1. That an application was filed for a conditional use permit in accordance with the provisions of Section 4.19.070 of the Zoning Ordinance of the City of Cypress to construct a 196 square-foot building addition onto an existing flood control pump station facility located at 4363 Ball Road within the PS Public and Semi-Public Zone. 2. That the City Council, after proper notice thereof, duly held a public hearing on said application as provided by law. 3. That the City Council hereby finds that: a. The proposed location of the conditional use is in accord with the objectives of the Zoning Ordinance and the purpose of the PS Public and Semi- Public Zone in which the site is located, which is: Intended for public uses other than street rights-of-way. b. The proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare, or be materially injurious to properties or improvements in the vicinity in that: (1) The existing public utility use (flood control pump station) is a conditionally permitted use in the PS Zone where it is located. (2) The proposed restroom and office addition to the existing public use is compatible with the surrounding flood control retarding basin and residential uses. The subject facility is not permanently manned and the proposed building addition area would only be manned during periodic maintenance or flood event monitoring activities. (3) The design of the proposed building addition would be consistent with the style and materials of the existing facility pump station building. The one-story building addition would also be compatible with the adjacent one-story and two-story residential structures located adjacent to the east property line. (4) Sufficient access and parking is provided onsite at the existing flood control pump facility to accommodate the service personnel visiting the site. c. The proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance, except for the associated Variance No. 2009- 02. NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City of Cypress does hereby approve Conditional Use Permit No. 2008-03, subject to the conditions attached hereto as Exhibit "A".
