Resolution No. 6134 364 RESOLUTION NO. 6134 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING A ONE (1) YEAR EXTENSION OF CONDITIONAL USE PERMIT NO. 2007-13 - WITH CONDITIONS. THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS: 1. That a request was filed for a one-year extension of Conditional Use Permit in accordance with the provisions of Section 4.19.070 of the Zoning Ordinance of the City of Cypress for the construction of a commercial shopping center, including the on-site sale of beer & wine and general alcohol, on the property located at the northwest corner of Katella Avenue and Winners Circle within the PBP Planned Business Park Zone. 2. The City Council hereby finds that: a. The proposed location of the conditional use is in accord with the objectives of the Zoning Ordinance and the purpose and intent of the PBP Planned Business Park Zone in which the site is located, which is: To allow for the comprehensive, integrated development of compatible and complementary educational, professional and administrative offices, commercial centers, industrial park, open space, or any public or semi-public uses in a campus-like setting. b. The proposed commercial center with on-site sale of beer, wine, and general alcohol will be consistent with the goals, policies, and objectives of the City of Cypress General Plan, as updated in 2001. c. The proposed commercial shopping center with on-site sale of beer, wine, and general alcohol is consistent with the uses permitted in the PBP Planned Business Park Zone in that: (1) The proposed 13.3 acre commercial shopping center, including the on-site sale of alcoholic beverages, is consistent with the types of uses permitted within the Cypress Business & Professional Center Specific Plan. (2) The proposed sale of alcoholic beverages would provide a public convenience and necessity for citizens of the City and surrounding area. (3) Sufficient access and on-site parking will be provided for the proposed commercial shopping center. (4) The proposed commercial development would be compatible with surrounding properties and developments within the area. (5) The proposed project has been reviewed and found to be consistent with the goals and objectives of the Redevelopment Plan for the Cypress Merged and Amended Project Area. d. The proposed use, as conditioned, will be consistent with the provisions of the Cypress Zoning Code and Cypress Business & Professional Center Specific Plan, as amended. NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City of Cypress does hereby approve the extension of Conditional Use Permit No. 2007-13, subject to the conditions attached hereto as Exhibit "A". • 365 PASSED AND ADOPTED by the City Council of the City of Cypress at a regular meeting held on the 13th day of April, 2009.
