RESOLUTION NO. 5985
A RESOLUTION OF THE CYPRESS RECREATION AND PARK DISTRICT
APPROVING A GRANT DEED FOR CONVEYANCE OF CERTAIN REAL PROPERTY
USED FOR RECREATION AND PARK PURPOSES FROM THE CYPRESS
REDEVELOPMENT AGENCY TO THE CYPRESS RECREATION AND PARK
DISTRICT
WHEREAS, the Cypress Redevelopment Agency ( "Agency ") is a public body,
corporate and politic, organized and existing under the California Community
Redevelopment Law (Health & Safety Code § 33000 et seq.); and
WHEREAS, the Cypress Recreation and Park District is a special district
organized and existing as a dependent special district under the laws of the State of
California ( "District "); and
WHEREAS, the Agency, in accordance with California law, previously acquired
certain real property within the Cypress Merged Redevelopment Project Area, a portion
of which property (hereinafter, the "Property ") later became the site for certain public
recreation and park improvements as part of the City's Civic Center complex; and
WHEREAS, now that such recreation and park improvements have been
completed on the Property, it is appropriate for the Agency to convey the Property to the
District so that the Property can be both owned and managed by the District; and
WHEREAS, the California Community Redevelopment Law, at Health and Safety
Code Sections 33430 and 33431, authorized the Agency to convey the Property to the
District; and
WHEREAS, a joint public hearing of the Agency and District with respect to the
conveyance was duly noticed in accordance with Health and Safety Code Section
33431 and was held on the matter of the proposed conveyance; and
WHEREAS, all actions required to be taken by the Agency and District precedent
to the adoption of this Resolution were duly and regularly taken in accordance with
applicable law;
NOW, THEREFORE, the Cypress Recreation and Park District resolves as
follows:
Section 1. The foregoing Recitals are true and correct and incorporated
herein.
Section 2. The District finds and determines as follows:
A. The conveyance of the Property to the District effectuates District
purposes in that it allows, without acquisition cost to the District, acquisition of
recreation and park property on which District operations and programs occur.
B. The Agency's conveyance of the Property to District is, in the
District's independent judgment, exempt from the California Environmental Quality Act
pursuant to 14 C.C.R. §§ 15060(c)(2), 15061(b)(3), and 15301.
Section 3. The District approves the conveyance of the Property to the District
and approves the form of Grant Deed therefore presented by District staff concurrent
with consideration of this Resolution. The District Chairperson is authorized and
directed to sign the Grant Deed on behalf of the District and the Acting District Manager
is authorized and directed to take such further actions, including but not limited to
recordation of the Grant Deed, and sign such other and further documents to effectuate
the purposes of this Resolution and of the Grant Deed. The Acting District Manager is
further authorized and directed to sign the Certificate of Acceptance for the Grant Deed
on behalf of the District.
