RESOLUTION NO. 5591
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS GRANTING A
VARIANCE FROM THE TERMS OF THE ZONING ORDINANCE OF THE CITY OF
CYPRESS, SECTION 15.5, TABLE 15.5.8 TO ALLOW REDUCED FRONT AND REAR
YARD BUILDING SETBACKS FOR THE PROPOSED SOUTHERN CALIFORNIA WATER
COMPANY WATER RESERVOIR AND PUMPHOUSE BUILDING LOCATED AT 4792
SIMONE WAY.
VARIANCE NO. 2001-03
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES,
DETERMINES, AND ORDERS AS FOLLOWS:
1. That an application was filed for a variance from the terms of the Zoning Ordinance
of the City of Cypress, Sections 15.5, Table 15.5.8, and 15.5.11 of the Cypress Zoning Code to
allow a reduction in the required front yard setback from thirty feet (30') to twenty -five feet (25'),
and rear yard setback from twenty -five feet (25') to twenty feet (20') for the proposed Simone
Water Reservoir and Pump House building on the property located at 4792 Simone Way within the
PS Public and Semi- Public Zone.
2. That the City Council, after proper notice thereof, duly held a public hearing on said
application as provided by law.
3. That in accordance with Section 35.107. of the Zoning Ordinance of the City of
Cypress, the City Council hereby finds that:
(a) That strict or literal interpretation and enforcement of the specified
regulation would result in practical difficulty or unnecessary physical hardship inconsistent
with the objectives of this chapter because due to the irregular shape of the property,
insufficient area is provided to locate the reservoir and pumphouse in accordance with the
required building setbacks.
(b) That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved which do not apply generally to other properties in the
same zone because, the subject property is irregular in shape and is bordered by the
Pacific Electric railroad on the north and the Moody Creek Flood Control Channel on the
south.
(c) The granting of this variance will not constitute the granting of a special
privilege inconsistent with the limitations on other properties in the vicinity classified in
the same zone.
(d) That the granting of the variance will not be materially detrimental to the
public health, safety, or welfare, or materially injurious to properties or improvements in
the vicinity. Additionally, as conditioned, the proposed building addition will be subject
to all applicable Health and Safety Code, Building Code, Fire Safety Code, and City Code
requirements.
(e) That the granting of the variance will not create any inconsistency with any
objective contained in the City's General Plan.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City of
Cypress does hereby approve Variance No. 2001 -03, subject to the conditions attached as Exhibit
PASSED AND ADOPTED by the City Council of the City of Cypress at a regular meeting
held on the 22nd day of July, 2002.
