Resolution No. 5464 28 RESOLUTION NO. 5464 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS ADOPTING THE NEGATIVE DECLARATION PREPARED IN CONNECTION WITH THE SECOND AMENDMENT TO THE REDEVELOPMENT PLAN FOR THE LOS ALAMITOS RACE TRACK AND GOLF COURSE REDEVELOPMENT PROJECT AREA THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS: 1. That a Negative Declaration has been presented to the City Council of the City of Cypress ("Council") in conjunction with this Council's consideration of the adoption of the Second Amendment to the Redevelopment Plan for the Los Alamitos Race Track and Golf Course Redevelopment Project ("Second Amendment"); and 2. That the Negative Declaration referred to in this resolution consists of that document dated February 28, 2001, entitled "Negative Declaration" and all written comments on that document and written responses thereto; and 3. That according to provisions in the California Environmental Quality Act and the California Community Redevelopment Law, Health and Safety Code Section 33000, et. seq., the Council must adopt the Negative Declaration prior to acting on an ordinance to adopt said Second Amendment; and 4. That all legal prerequisites to the adoption of this Resolution have occurred. NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City of Cypress does hereby: 1. Certify that the Negative Declaration, attached hereto as Attachment A, has been prepared on the subject of the Second Amendment in accordance with the provisions of the California Environmental Quality Act, California Public Resources Code Sections 21000, et seq., and in accordance with the regulations promulgated thereunder. Further, the Council hereby certifies that it has considered the contents of the Negative Declaration in considering the adoption of the Second Amendment. 2. Certify that the Negative Declaration does not identify physical environmental impacts inherent in the project (Second Amendment). Accordingly, the Council hereby finds, on the basis of the whole record before it, including the initial study and all comments received, that there is no substantial evidence that the subject project will have a significant effect on the environment. 3. Certify that the Negative Declaration reflects the independent judgment and analysis of the Council. 4. Adopt the Negative Declaration. 5. Direct the City Clerk that upon final adoption of an ordinance approving the Second Amendment, referenced herein, a Notice of Determination shall be filed with the Clerk of the Board of Supervisors of Orange County in accordance with the California Environmental Quality Act reflecting the findings made in this resolution. 6. Nature and Description of Project Second Amendment to the Los Alamitos Race Track and Golf Course Redevelopment Project Area Plan A request to amend the Los Alamitos Race Track and.Golf•Course'Redevelopment Project Area Plan to extend the eminent domain provisions for a period of twelve (12) years from the date the ordinance approving the amendment becomes effective,and to add a section requiring that all land uses permitted by the Redevelopment Plan also be permitted by the General Plan and Zoning Ordinance as well as all other state and local building codes, guidelines, or specific plans as they exist now or are hereafter amended. Minor nonsubstantive text changes are also proposed that will bring the Plan into conformity with current State Redevelopment Law. (The Second Amendment is presented in the form of an Amended and Restated Redevelopment Plan for the Los Alamitos Race Track and Golf Course Project). 2. Findings This project will not have a significant effect on the environment since: A. This project will not create a substantially adverse physical change within the affected area, including land, air, water, minerals, flora, fauna, ambient noise, and objects of historic or aesthetic significance. B. The project is consistent with the goals and policies of.the.Los Alamitos Race Track and Golf Course Redevelopment Project Area Plan. . C.
