Resolution No. 5488 157 RESOLUTION NO. 5488 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING TIME EXTENSION NO. 2 OF CONDITIONAL USE PERMIT NO. 99-1 -WITH CONDITIONS. THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS: 1. That an application was filed to amend a conditional use permit in accordance with the provisions of Section 17.2 of the Zoning Ordinance of the City of Cypress to allow a twenty- four (24) month extension to the Phase 2 development completion provisions of Conditional Use Permit No. 99-1, an automotive repair, painting, and towing use located at 5640 Lincoln Avenue within the PC Planned Community Zone,Lincoln Avenue Specific Plan Area. 2. That the City Council, after proper notice thereof, duly held a public hearing on said application as provided by law. 3. That the City Council hereby finds that: a. The proposed location of the amended conditional use is in accord with the objectives of the Zoning Ordinance and the purpose of the PC Zone in which the site is located, which is: Intended to permit a compatible mix of land uses, planned commercial developments and business parks, and a variety of housing styles and densities. b. The proposed location of the amended conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare, or be materially injurious to properties or improvements in the vicinity in that: (1) The proposed time extension does not change the previously approved project description or the previously adopted findings for approval of the project. (2) The proposed time extension of the previously approved two-phased project merely extends the time to complete the site improvements to upgrade the existing condition of the property, which will still be consistent with the goals and policies of the Lincoln Avenue Redevelopment Project Area Plan and the Cypress General Plan. c. The proposed amended conditional use will comply with each of the applicable provisions of the Zoning Ordinance and the Lincoln Avenue Specific Plan, except for associated landscaping and temporary outdoor overnight parking variances approved under Variance No. 99-1. NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City of Cypress does hereby approve Extension No. 2 of Conditional Use Permit No. 99-1, subject to the amended condition attached hereto as Exhibit "A". The Phase 2 project improvements shall include: removal of the Phase 1 overnight parking enclosure wall, construction of the new building, interior and exterior improvements to the existing building, and construction/installation of additional landscape buffer areas around the new and existing buildings, consistent with the approved Phase 2 Site Plan and Elevation Drawings. Failure to comply with any of these deadlines shall result in the reconsideration of this matter before the City Council, to include such alternatives as revoking the provisions for temporary outdoor overnight parking under Variance No. 99-1 and/or revocation of the Conditional Use Permit in part or in entirety. • Submit building plans into plan check by March 28, 2002. • Obtain construction financing by September 28, 2002. • Obtain building permit and initiate construction by March 28, 2003. • Complete construction of new building by September 28, 2003. • Complete matching exterior improvements to existing building by December 28, 2003.
