Resolution No. 5506 226 RESOLUTION NO. 5506 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS GRANTING A VARIANCE FROM THE TERMS OF THE ZONING ORDINANCE OF THE CITY OF CYPRESS, SECTION 19, DIVISION 2, TABLE 19.13, ITEMS 2 AND 8 TO ALLOW AN ANTENNA STRUCTURE CLOSER THAN TEN FEET (10') TO ANOTHER STRUCTURE AND CLOSER THAN 300 FEET TO A RESIDENTIAL ZONE. VARIANCE NO. 2001-04 THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS: 1. That an application was filed for a variance from the terms of the Zoning Ordinance of the City of Cypress, Section 19, Division 2, Table 19.13, Items 2 and 8, to allow an antenna structure closer than ten feet (10') to another structure and closer than 300 feet to a residential zone. The proposed antenna facility site is located at 4129 Ball Road within the CG-10,000 Commercial General Zone. 2. That the City Council, after proper notice thereof, duly held a public hearing on said application as provided by law. 3. That in accordance with Section 19.23 of the Zoning Ordinance of the City of Cypress, the City Council hereby finds that: (a) Locating the antenna in conformance with the specifications of Section 19, Division 2, Table 19.13, Item 8 of the Cypress Zoning Ordinance would obstruct the antennas reception window or otherwise excessively interfere with reception, and such obstruction or interference involves factors beyond the applicant's control, because the applicant claims that locating the proposed antenna structure on a site further to the north or south would create signal interference with other nearby Cingular antenna facilities and/or create holes in the network reception resulting in cell phone calls being interrupted and disconnected. (b) Locating the antenna in conformance with the specifications of Section 19, Division 2, Table 19.13, Item 2 of the Cypress Zoning Ordinance would result in the displacement of at least one (1) parking space and would decrease the distance from the antenna structure to the residential zone located to the north. NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City of Cypress does hereby approve Variance No. 2001-04.
