RESOLUTION NO. 5520
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS, DECLINING TO
ENACT A PROGRAM OF PREFERENCES IN CITY EMPLOYMENT FOR VETERANS OF THE
ARMED FORCES AND EXPLAINING ITS REASONS FOR DOING SO AS REQUIRED BY
GOVERNMENT CODE SECTION 50088.
WHEREAS, in 1999, the California Legislature enacted Government Code Section
50088 (b) which requires all local governments to take action by January 1, 2002, to either (1)
enact a system of employment preferences for veterans of the armed forces or (2) adopt a
resolution explaining why the local government declined to adopt such a system of preferences;
and
WHEREAS, the City of Cypress has consistently and successfully operated under the
merit principal of employment; and
WHEREAS, pursuant to the City of Cypress and Cypress Recreation and Park District
Personnel Rules and Regulations, the appointing power may appoint any eligible applicant on
the list regardless of rank or final score; and
WHEREAS, the City of Cypress currently employs a significant number of military
veterans who have successfully gained employment and promotions without the aide of
preference systems; and
WHEREAS, the City of Cypress encourages military service by its employees by
providing full pay and benefits during annual military training and by providing full benefits and
pay supplements during times of national emergencies.
NOW, THEREFORE, BE IT RESOLVED that, pursuant to Government Codes 50088
(b), the City of Cypress declines to adopt a system of preferences for veterans of the armed
forces in employment process due to the following reasons:
1. The foregoing recitals are true and correct; and
2. The appointing power may appoint any eligible applicant on the list regardless of
rank or final score and the existing system adequately affords appropriate preferences, when
warranted.
3. The appointing power has and will continue to encourage military veterans to
apply for employment opportunities.
PASSED, APPROVED AND ADOPTED by the City Council of the City of Cypress at a
regular meeting held on the 14th day of January, 2002.
