4 01 RESOLUTION NO. 5555 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS ADOPTING THE NEGATIVE DECLARATION PREPARED IN CONNECTION WITH THE WICKER DRIVE RESIDENTIAL DEVELOPMENT THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS: 1. That a Negative Declaration has been presented to the City Council of the City of Cypress ("Council") in conjunction with this Council's consideration of the adoption of the Purchase and Sale and Escrow Instructions between the Cypress Redevelopment Agency and Fieldstone Communities, Inc. (the "Wicker Drive Residential Development"); and 2. That the Negative Declaration referred to in this resolution consists of that document dated March 29, 2002, entitled "Wicker Drive Residential Development" ("Negative Declaration") and all written comments on that document and written responses thereto; and 3. That according to provisions in the California Environmental Quality Act and the California Community Redevelopment Law, Health and Safety Code Section 33000, et. seq., the Council must adopt the Negative Declaration prior to acting on a resolution to adopt said Purchase and Sale and Escrow Instructions; and 4. That all legal prerequisites to the adoption of this Resolution have occurred. NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City of Cypress does hereby: 1. Certify that the Negative Declaration, attached hereto as Attachment A, has been prepared on the subject of the Wicker Drive Residential Development in accordance with the provisions of the California Environmental Quality Act, California Public Resources Code Sections 21000, et seq., and in accordance with the regulations promulgated thereunder. Further, the Council hereby certifies that it has considered the contents of the Negative Declaration in considering the adoption of the Purchase and Sale and Escrow instructions. 2. Certify that the Negative Declaration does not identify physical environmental impacts inherent in the project (Wicker Drive Residential Development). Accordingly, the Council hereby finds that the subject project will not have a significant effect on the environment. 3. Adopt the Negative Declaration. 4. Direct the City Clerk that upon final adoption of a resolution approving the Purchase and Sale Agreement, a Notice of Determination shall be filed with the Clerk of the Board of Supervisors of Orange County in accordance with the California Environmental Quality Act reflecting the findings made in this resolution. CITY OF CYPRESS 5275 Orange Avenue Cypress, California 90630 NEGATIVE DECLARATION In accordance with the requirements of Resolution No. 4363 of the City of Cypress regarding the adoption of objectives, criteria and procedures implementing the California Environmental Quality Act as amended, the Assistant Community Development Director of the City of Cypress, acting as the Responsible Official,has prepared the following Negative Declaration: 1. Nature and Description of Project Wicker Drive Residential Development: located at the northwest corner of Orange Avenue and Walker Street, within the current OP/CC and PRD/CC Zone. 2. Findings This project will not have a significant effect on the environment since: A. This project should not create a substantially adverse physical change within the affected area, including land, air, water, minerals, flora, fauna, ambient noise, and objects of historic or aesthetic significance. B. This project will be subject to conditions of approval and mitigation measures incorporated as conditions of approval that will address potential impacts generated by this project and reduce them individually and collectively to a level of insignificance. A list of these Mitigation Measures is attached. C. This project will be developed in conjunction with a Specific Plan, which will be in full consistency with the Cypress General Plan as adopted on September 10, 2001. Respectfully submitted, Ted J.
