ORDINANCE NO. 1003
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS,
CALIFORNIA AMENDING SECTION 7.5 OF THE CYPRESS ZONING
ORDINANCE REGARDING THE REGULATION OF HEDGES, SHRUBBERY,
STRUCTURES AND OTHER OBSTRUCTIONS IN SIGHT CLEARANCE
VISIBILITY ZONES AND AMENDING SECTION 35.123 OF THE CYPRESS
ZONING ORDINANCE REGARDING ADMINISTRATIVE ADJUSTMENT
PROCEDURES.
WHEREAS, the City Council of the City of Cypress recognizes that regulation of
hedges, shrubbery, structures and other obstructions within sight clearance visibility
zones is necessary to maintain and protect the general public health, safety and welfare,
and to prevent possible traffic and safety hazards while preserving community aesthetics;
and
WHEREAS, the City Council is amending section 7.5 of the Cypress Zoning
Ordinance in order to conditionally regulate hedges, shrubbery, structures and other
obstructions in sight clearance visibility zones; and
WHEREAS, the City Council of the City of Cypress recognizes that
Administrative Adjustments are an appropriate procedure for granting minor relief from
development standards when the granting of such relief will provide for better design and
function; and
WHEREAS, the City Council is amending section 35.123 of the Cypress Zoning
Ordinance to conditionally allow site - specific maintenance of trees, hedges, shrubbery,
structures and other similar minor visibility obstructions in required sight clearance
visibility zones through the Administrative Adjustment process.
NOW, THEREFORE, the City Council of the City of Cypress hereby ordains as
follows:
Section 1: Section 7.5 of the Cypress Zoning Ordinance is hereby amended in its
entirety as follows:
Sight Clearance Visibility
On corner lots at the intersection of two or more highways, streets or common
driveways or combinations thereof, or wherever a private driveway provides access to a
street or alley, in all districts, no fence, wall, hedge, sign, structure, shrubbery, mound
of earth or other visual obstruction over forty-two (42) inches in height, as measured
from adjacent street curb elevation, shall be erected, placed, planted or allowed to grow
within the triangular space referred to as the "sight clearance visibility triangle" . The
sight clearance visibility triangle shall be the area; (1) formed by the intersection of
extended curblines and a line joining points on the curb fifteen (15) feet (measured
along the curblines) from the point of intersection of the curbline extensions as
illustrated in Figure 7.5(A), or; (2) formed by a right - angled triangle having a base
along the street or alley and a side of fifteen (15) feet along the private driveway as
illustrated in Figure 7.5(B).
A. The sight clearance visibility triangle shall be shown on all landscaping plans,
grading plans and tentative tract maps when required by the Community
Development Director. Any landscape plan submitted shall show the common
name, locations and mature dimensions plotted to scale of all proposed trees, shrubs
and plants within the sight clearance visibility triangle.

B. Proposed improvements, structures or vegetation which exceed the forty-two (42)
• inch height limit may be permitted in the sight visibility triangle by the Community
Development Director through the Adjustment process, upon determination by the
Director of Public Works that the location and /or height of the existing or proposed
hedge, shrubbery, structure or other obstruction within the sight visibility triangle
allows for the safe view of oncoming traffic, bicyclists and pedestrians by a driver
approaching an intersection or juncture between street and private driveway, and
thus no sight visibility impacts would result.
Section 2 Section 35.123 is hereby amended by adding subsection (A)(11) as
follows:
Sect. 35.123 (A)
(11) The keeping of any tree, hedge, shrubbery, vegetation, structure.
decoration, design, device, or any other minor visibility obstruction in
required sight clearance visibility zones which exceeds three and one -half (3
1/2) feet in height as measured from adjacent grade.
Section 3: The City Clerk of the City of Cypress shall certify to the passage and
adoption of this ordinance and the same shall be posted as required by law and shall
take effect as provided by law.
FIRST READING at a regular meeting of the City Council of said City held on
the 25th day of September , 2000, and finally adopted and order posted at a regular
meeting held on the 9th day of October, 2000.
