Ordinance No. 101193 ORDINANCE NO. 1011 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS, CALIFORNIA, AMENDING SECTIONS 29.11(A)(B), 29.27(A)(H), AND 29.29(A) OF THE CYPRESS ZONING ORDINANCE RELATING TO TEMPORARY SIGNS AND BANNERS WHEREAS, the City Council of the City of Cypress recognizes that the regulation of signs and banners is necessary to protect the general public health, safety, and welfare, while preserving community aesthetics; and WHEREAS, the City Council is amending Sections 29.11(A)(B), 29.27(A)(H), and 29.29(A) of the City of Cypress Zoning Ordinance in order to better regulate the installation, use, and placement of temporary signs and banners on both private property and within the public right - of -way and other public domains. NOW, THEREFORE, the City Council of the City of Cypress hereby ordains as follows: Section 1: Section 29.11(A)(B) of the Cypress Zoning Ordinance is hereby amended to read in its entirety as follows: Section 29.11(A)(B) Signs over the public right of way. (A). (A). No sign or banner shall encroach upon or overhang adjacent to any public right -of- way without first having received approval from the Community Development Director and the Public Works Director, or their designee. (B). No sign shall be attached or otherwise affixed to any street, meridian, island, sidewalk, traffic signal, utility pole, wire, traffic control device, building, wall, bridge, railroad trestle, hydrant, street tree, shrub, tree stake or tree guard, street sign, or any other public facility located within the public right of way. (B). No sign shall be attached or otherwise affixed to any street, meridian, island, sidewalk, traffic signal, utility pole, wire, traffic control device, building, wall, bridge, railroad trestle, hydrant, street tree, shrub, tree stake or tree guard, street sign, or any other public facility located within the public right of way, or any other public facility located within the public right -of -way, or any other domain owned or controlled by the City of Cypress without first having received approval from the Community Development Director and the Public Works Director, or their designee. Section 29.27(A)(H) of the Cypress Zoning Ordinance is hereby amended to read in its entirety as follows: Temporary signs, as defined in this Section 29, shall be subject to the following regulations: (A). No temporary sign shall be permitted on or extend over any public property or public easement. (A) No temporary sign shall be permitted on or extend over any public property or public easement or any other domain owned or controlled by the City of Cypress without first having received approval from the Community Development Director and the Public Works Director, or their designee. (H). The use of temporary signs, including banners shall be limited to a total of 11 days (H). The placement, use, and keeping of temporary signs and banners shall be subsequent to the issuance of a Temporary Use Permit (TUP) from the Community Development Department. The use of temporary signs, including banners, shall be limited to a total of 14 days within any three -month period, for no more than a total of 30 days per calendar year. Temporary signs and banners erected by the City of Cypress, the Cypress Park and Recreation District, and non- profit fraternal, sororal, social and sports organizations as specified by the Cypress Park and Recreation District shall be limited to forty -five (45) contiguous days, with temporary signs and banners erected no more than forty (40) day prior to an event date, and removed within five (5) days of the conclusion of the event. 94 Section 29.29(A) of the Cypress Zoning Ordinance is hereby amended as follows: Non - profit organization special event signs Off -site signs of a temporary nature advertising a special event sponsored by a non - profit organization are permitted, subject to the following regulations: (A). Such signs shall not be erected sooner than 30 days prior to the event advertised thereon and shall be removed within five (5) days after the event has concluded. (A). Off -site signs and banners erected by the City of Cypress, the Cypress Park and Recreation District, and non - profit fraternal, sororal, social, and sports organizations as specified by the Cypress Park and Recreation District shall not be erected sooner than forty (40) days prior to the event advertised thereon and shall be removed within five (5) days after the event has concluded. Section 2: The City Clerk of the City of Cypress shall certify to the passage and adoption of this ordinance and the same shall be posted as required by law and shall take effect as provided by law.
