Ordinance No. 101295 ORDINANCE NO. 1012 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS CALIFORNIA AMENDING SECTIONS 9, 29 AND 35, APPENDIX "A" OF THE CYPRESS ZONING ORDINANCE (RESIDENTIAL ZONES, SIGNS, AND ADMINISTRATION OF THE ZONING ORDINANCE), AMENDING SECTIONS 9.5, 29.5, 31.153, 31.155 AND 35.161 REGARDING DESIGN REVIEW. WHEREAS, the City Council of the City of Cypress recognizes that regulation of design review is necessary to ensure that development, buildings, or structures will conserve the values of adjacent properties and will not prove detrimental to the character of buildings or uses already established in the area; and WHEREAS, the City Council is amending Sections 9.5, 29.5, 31.153 and 35.161 to the Cypress Zoning Ordinance in order to ensure the above, NOW, THEREFORE, the City Council of the City of Cypress hereby ordains as follows: Section 1: Section 9.5C.3. of the Cypress Zoning Ordinance is hereby amended to read as follows: 9.5 Development Standards. C. In addition to the general standards of this Section, the following special standards also apply to residential zones: 3. Additions to the original permitted structure shall not exceed the maximum height of the original structure in any residential zone, excluding chimneys and roof - mounted mechanical equipment, except subject to Design Review unless approved by the Staff Review Committee. Section 2: Section 29.5 of the Cypress Zoning Ordinance is hereby amended to read as follows: 29.5 Design review for signs — When required. The following types or conditions of signs shall be subject to Design Review pursuant to the provisions of Section 35, Division 11 (Design Review) of this ordinance: A. Signs animated by illumination in the PS 1A, CG 10000, and CH 10000 zones. B. Signs attached to a building which project above the eave line. C. Roof signs where no building setback is provided. D. Signs painted on buildings in the CH 10000 zone. E. Flags, emblems, insignias, and posters of any nation, state, international organization, political subdivision, or other governmental agency, unlighted temporary displays of patriotic, religious, charitable, or civic character that exceed 35 feet in height. F. All single faced, lighted wall signs for commercial uses in freestanding buildings located in the CG 10000 zone, except automobile service stations. G. Any sign in the CH 10000 zone permitted in addition to those provided for in this Section. H. Monument signs in the MP 20000 zone. I. All freestanding signs, except special purpose signs as designated in Section J. Freestanding, double faced monument signs within the PCM zone. 96 A. New sign programs for commercial and industrial centers /complexes or substantive modifications thereto for those programs previously approved by the Staff Review Committee and confirmed by the City Council. The Community Development Director shall make the determination of what constitutes a substantive modification. Subsequent sign proposals within the center /complex consistent with the approved sign program shall be subject only to Building and Planning Division review. B. All other signs consistent with the provisions of Section 29 shall be subject only to Building and Planning Division review. Section 3: Section 35.153 of the Cypress Zoning Ordinance is hereby amended to read as follows: 35.153 Applicability. The Design Review Process shall be required prior to the issuance of any building permit for the following: 1. Single family residential subdivisions with two (2) or more units. 2. Multiple family developments. 3. Mobilehome parks. 11. Additions to residential structures that exceed the maximum height of the original structure (see Section 9.5(c)(3)). 5. New commercial and industrial developments. buildings or additions to existing buildings where the proposed additional square footage exceeds 20 % of the total floor area on the site. 6. Public and semi - public uses. 7. Satellite dish antenna. 8. New sign programs for commercial or industrial centers. Section 4: Section 35.155.A. of the Cypress Zoning Ordinance is hereby amended to read as follows: A. A ! - -- Staff Review Committee, comprised of City staff, is hereby established for the purpose of conducting design review. Section 5: Section 35.155.B. of the Cypress Zoning Ordinance is hereby amended to read as follows: B. The Design Review Committee Staff Review Committee shall be responsible for reviewing relevant applications for conformance with the provisions of this ordinance and in particular, for conformance with the design standards and principles set forth in this Division 11. Section 6: Section 35.155.C. of the Cypress Zoning Ordinance is hereby amended to read as follows: C. In performing the duties of Design Review, the Staff Review Committee shall be guided by the statement of Design Review purpose set forth in Section 35.151 (Intent and Purpose) above. Further, the Committee shall work to bar the unsightly, the inharmonious, the monotonous, and the hazardous to ensure that proposed improvements will not impair -the desirability of investment or occupancy n arby. However, originality in site planning, architecture, landscaping, and graphic design shall not bo uppressed. Consideration shall be given to use, parcel size and shape, setbacks from all property lines, land coverage, building height and bulk, landscaping, access, parking, circulation, architecture and compatibility with surrounding properties in the evaluation of applications. Section 7: Section 35.155.D. of the Cypress Zoning Ordinance is hereby amended to read as follows: D. Review by the Staff Review Committee shall include exterior design, materials, textures, colors, quality and compatibility of new building elements and design features with those remaining on the site and means of illumination but shall not consider elements of design that are not visible beyond the boundaries of the site. The Committee shall be guided by the principal of consistency in the use of material and color control, recognizing that visual interest should be created through original design rather than through the application of cosmetic event. Section 8: Section 35.161 of the Cypress Zoning Ordinance is hereby amended to read as follows: 35.161. Appeals and effective date of decision The decisions of the Staff Review Committee are considered final unless appealed by the project proponent to the Community Development Director within ten (10) days. The effective date of the Committee's decision shall be the date of acceptance by the Planning Agency and upon receipt by the Community Development Department of an agreement signed by the applicant agreeing to any conditions of approval.
