ORDINANCE NO. 1021
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CYPRESS CALIFORNIA, AMENDING SECTIONS 25.19(A)(B) AND
41.51 OF THE CYPRESS ZONING ORDINANCE
WHEREAS, the City of Cypress recognizes the regulation of parking vehicles
within the front yard areas of residential sites is necessary to protect the general public
health, safety and welfare, while preserving community aesthetics; and
WHEREAS, the protection of the public's health, safety, and welfare, and the
preservation of community aesthetics requires effective measures for achieving such
ends; and
WHEREAS, Sections 25.19(A)(B) of the Cypress Zoning Ordinance is in need of
amendment to more effectively control the parking of vehicles in the front yard areas of
residential sites through the redesignation of approved parking areas in residential front
yards, and the establishment of fines for violations thereof; and
WHEREAS, Section 41.51 of the Cypress Zoning Ordinance is in need of
amendment to more clearly define "front yard" and precisely set forth allowable and
prohibited parking areas therein, and
NOW, THEREFORE, the City Council of the City of Cypress hereby ordain as
follows:
Section 1: Section 25.19(A)(B) of the Cypress Zoning Ordinance is hereby
amended to read in its entirety as follows:
Section 25.19(A)(B) Parking in front yards of residential lots.

following manner:
(a) Direct - Access Garages /Carports. All vehicles parked in the front yard
area of a residential lot having a direct access garage or carpert (wherein
the point of entry is parallel, or generally parallel to the public right -of -way)
shall be placed on a fully paved surface in the area between the
garage /carport entrance and the public right -of -way. For parking
purposes, the width of this driveway shall be determined to be the same
as the width of the garage /carport. Vehicles may also be parked on an
ancillary fully paved parking area adjacent to, and between the driveway
and the closest adjacent property line. Such ancillary parking area shall
not exceed ten (10) feet in width as measured from the garage /carport and
the closest adjacent property line. Such parking practices shall be
governed by the attached diagram. Violations of the provisions of this
section 25.19(A)(a) shall be an infraction subject to the issuance of a
citation and shall be punishable by a fine of forty dollars ($40.00). Each
day a violation is committed shall be considered a separate offense
subject to the issuance of a separate citation.

(b) Indirect Access Garages /Carports. All vehicles parked in the front yard
area of a residential lot having an indirect access garage /carport (wherein
the point of entry is perpendicular, or generally perpendicular to the public
right -of -way) shall be placed on a fully paved surface between the
garage /carport entrance and the property line parallel to garage /carport
entrance. Vehicles may be parked adjacent to the property line in an area
extending from a prolongation of the rear -most wall of the garage /carport,
to a point ten (10) feet past a prolongation of the front facade of the
garage /carport. No vehicles shall be parked in the area between the front
garage /carport facade parallel to the public right -of -way and the right -of-
way itself. Such parking practices shall be governed by the attached
diagram. Violations of the provisions of this section 25.19(A)(b) shall be
an infraction subject to the issuance of a citation and shall be punishable
by a fine of forty dollars ($40.00). Each day a violation is committed shall
be considered a separate offense subject to the issuance of a separate
citation.

Section 2: Section 41.51 of the Cypress Zoning Ordinance is hereby amended to
read in its entirety as follows:
41.51. "Y" definitions.
Yard — An open space on a developed lot that, except as otherwise provided for
in this ordinance, is unoccupied or unobstructed from the ground upwards; and, when a
yard dimension is given, it represents the minimum horizontal distance between the lot
line from which the distance must be measured and a line parallel to the lot line.

Yard, front - The open space on a developed lot extending across the full width of
the front of the lot, the depth of which extends from the rear of the public right -of -way to
the most distant forward- facing facade of the dwelling and its attached garage or
carport. When applied to a multi - family dwelling, these standards shall be applied to the
dwelling, garage, or carport closest to the public right -of -way by which access to the site
is taken.
Yard, Rear— The open space extending across the full width of the rear of a lot,
the depth of which is the horizontal distance between the rear lot line and a line parallel
thereto on the lot.
Yard, side — The space between the main building on the side lot line, extending
from the front yard to the rear yard; the measured distance of the yard shall represent
the shortest distance between the side lot line and that portion of the main building
nearest the line from which the measurement is taken.
FIRST READING at a regular meeting of the City Council of said City held on the
day of 11th day of February, 2002, and finally adopted and order posted at a regular
meeting held on the 25th day of February, 2002.
