AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF CYPRESS AMENDING SECTION 2-2.4
"AGENDA" OF THE CODE OF THE CITY OF
CYPRESS BY REPLACING SAID SECTION WITH A
NEW SECTON 2-2.4 "AGENDA" ESTABLISHING
TIME FRAMES FOR THE DISTRIBUTION AND
ADDING OF ITEMS TO CITY COUNCIL AGENDAS
THE CITY COUNCIL OF THE CITY OF CYPRESS DOES ORDAIN
AS FOLLOWS:
SECTION I. Section 2-2.4 of the City of Cypress is
hereby amended to read as follows:
"SEC. 2-2.4 SAME-AGENDA.
(a) The city clerk shall prepare an agenda of
the council proceedings, which agenda shall be
prepared in accordance with the order of business,
and shall furnish each member of the council, the
mayor, the city manager and city attorney with a
copy of the same not less than seventy-two (72)
hours prior to each meeting. Any councilman may
cause matters to be added to such agenda by filing
a written request therefor with the city clerk not
less than one week prior to the meeting for which
such agenda is prepared. A majority of the
membership of the council may cause matters to be
added to the agenda for the next succeeding regular
or adjourned regular meeting by minute action of
the council. Matters that are not listed on the
agenda shall not be presented to the council except
matters of an urgent or emergency nature presented
by the city manager as provided by Government Code
Section 54954.2."
(b) Upon a determination of the City Council
by majority vote, action may be taken on items of
business not on the published agenda when a finding
that an emergency situation exists. An emergency
situation for the purposes of this section means
any of the following:
Work stoppage or other activity which
severely impairs the public health,
safety, or both, as determined by a
majority of the Members of the City
Council; or,
Crippling disaster which severely impairs
public health, safety, or both, as
determined by a majority of the Members
of the City Council.
(c) Upon a determination by two-thirds vote
of the City Council, or, if less than two-thirds of
the Members are present, by a unanimous vote of
those Members present, the City Council may act if
they find that the need to take action arose
subsequent to the agenda being posted as specified
in subdivision (a) above.
SECTION II. If any section, subsection,
subdivision, sentence, clause, phrase, or portion of this
Ordinance, or the application thereof to any person or
place, is for any reason held to be invalid or
unconstitutional by the decision of any court of competent
jurisdiction, such decision shall not affect the validity of
the remaining portions of this Ordinance or its application
to other persons or places. The City Council hereby
declares that it would have adopted this Ordinance, and each
section, subsection, subdivision, sentence, clause, phrase,
or portion thereof, irrespective of the fact that any one or
more sections, subsections, subdivisions, sentences,
clauses, phrase or portion of the application thereof to any
person or place, be declared in valid or unconstitutional.
SECTION III.The City Clerk is hereby authorized and
directed to certify as to the passage of this Ordinance and
to give notice thereof by causing copies of this Ordinance
to be posted in three public places throughout the City.
FIRST READ at an adjourned regular meeting of the
City Council of said City held on the 15th day of March
1988, and finally adopted and ordered posted at a regular
meeting held on the 28th day of March 1988.

Attached Ordinance Incorporating Recent Amendments
to the Brown Act For Your March 14, 1988 Meeting
The attached Ordinance reflects proposed changes to
Section 2-2.4 of the Cypress City Code. These changes are
required to conform to recent changes in the Brown Act.
The City Council has been utilizing procedures as
required by these amendments; however, this Ordinance
revision will incorporate the Council practice within the
City Code.
RECOMMENDATION:
I recommend that the City Council introduce the
attached Ordinance for a first reading and set it for a
second reading at your March 28th Meeting.
