Minutes 1974-09-19MINUTES OF A REGULAR MEETING OF THE CYPRESS PLANNING COMMISSION HELD September 19, 1974 The regular meeting of the Cypress Planning Commission was called to order at 7 :35 p.m. on Thursday, September 19, 1974 in the Cypress City Council Chambers, 5275 Orange Avenue, Cypress, California, Chairman Hilliard Warren presiding. PRESENT* Commissioners Greenwood, Hart, Mullen and Warren ABSENT: None Also present were Planning Director Brian Hawley, Associate Planner Ron Hovland, Building Superintendent Oliver Grant, Civil Engineering Assistant Frank Dalesandro, and Deputy City Attorney Roger Grable. PLEDGE OF ALLEGIANCE: Commissioner Hart led the pledge of allegiance. MINUTES: It was moved by Commissioner Mullen, seconded by Commissioner Greenwood and unanimously carried to approve the Planning Commission minutes of September 5, 1974 as corrected. ORAL COMMUNICATIONS: Chairman Warren inquired if anyone in the audience wished to speak in regard to any matter not on the agenda. There was no one who wished to speak. PUBLIC HEARING RE: RELOCATION PERMIT #74 -1, MR. TNF; 'VETZEL: Chairman Warren announced that this was the time and place for the public hearing to consider a proposed permit for the relocation of a building for storage use into an M -1 zone located at 8892 Watson Street. Included in this request is a variance to deviate from the minimum lot area and lot width. Chairman Warren declared the hearing open and requested that the staff present its report. The Associate Planner presented Staff Report PC#74 -42 dated September 13, 1974 for the Commission's consideration. Chairman Warren inquired if the applicant wished to speak. Mr. Lee Wetzel, 16273 Pioneer, Norwalk, California, expressed agreement with all conditions of approval and stated the use of the building would be deter- mined by the prospective tenants. Mr. Wetzel stated that he was aware certain uses required a conditional use permit and that tenants would be advised of this when applying for a business license. The applicant stated he would be willing to work with staff to determine landscaping for the site at the time the landscaping plans are submitted. The Commissioners inquired about the condition of the building and were advised by the Building Superintendent that it could be brought up to Code requirements. Commissioners Greenwood and Mullen indicated they felt the proposed use would be a desirable improvement for the particular neighborhood and that it probably would not be suitable in another location within the City. Chairman Warren closed the public hearing regarding Relocation Permit #74 -1. Planning Commission Minutes September 19, 1974 It was moved by Commissioner Hart and seconded by Commissioner Greenwood to approve Relocation Permit #74 -1, Mr. Lee Wetzel, and the accompanying variance subject to the following 39 conditions of approval and subject to the findings outlined in the staff report that the proposed relocation will be consistent with City Ordinance No. 383, that the granting of the permit will be consistent with the properties and general uses in the immediate vicinity and in the same zone classification, and that the granting of the permit will not be injurious to the health and safety of the cafmmunity or detrimental to properties or improvements in the vicinity: 1. The applicant shall conform to all additional requirements of Ordinance No. 383 for the relocation of` the' structure. 2. The structure shall be relocated in substantial conformance to the approved plot plan. 3. A parapet treatment shall be added to the easterly elevation similar to the three other elevations. 4. If the rear yard area is to be used for storage purposes, it shall be enclosed by a solid masonry block wall six -feet in height. 5. All roof - mounted equipment shall be screened froth public view and adjoining properties. 6. Landscape and irrigation plans shall be submitted for the review and approval''of the Planning Commission. 7. The proposed signing program for any use to be_ located in the structure shall conform to Section 15 of the Zoning Ordinance and shall be submitted for review and approval by the Planning Commission. 8. Approval of the Orange County Fire Marshall shall be obtained for all alterations to the structure upon relocation.' 9. All exterior lighting shall be positioned in such 'a way 'so as not to directly shine or reflect onto adjoining properties. 10. If the proposed occupancy is a use permitted in the M-1 Zone subject to the granting of a Conditional Use Permit, such a permit must be obtained prior to occupancy.' 11. Drainage fees shall be paid in accordance with Master Plan of Drainage. 12. Drainage shall be solved to the satisfaction of the City Engineer. A storm drain system shall be designed'for''this parcel to carry all run -off water to Watson Street. The design shall be capable of handling a ten year storm. 13. All secondary and primary utility services shall be underground. 14. A cash bond shall be posted for future curb, gutter, sidewalk, driveway, street pavement, street trees, and streetlights. 15. Necessary fire hydrants shall be installed in accordance with Fire Department requirements and City Standards. 16. Plan checking and inspection fees amounting to 3 1/2% of the street improvements shall be paid. 17. Developer shall conform to all applicable provisions of the City Code. -2- Planning Commission Minutes September 19, 1974 18. Sewer connection fees shall be paid in accordance with the Orange County Sanitation District fee schedule. 19. A one -story foundation and floor slab shall be provided. 20. Install a ventilation system to provide at least two changes of air per Your. Depending upon usage when determined, this air change minimum may be more - up to five C.U.F. /minute of outside air with a total being circulated of 15 C.P.M. per occupant in operation whenever building is occupied. All A/C equipment shall be placed in satisfactory operating condition. 21. If any toilet rooms are provided for use of the public, there shall be toilet roams installed as per the California require- ments for the handicapped (all restroam doors are too narrow to comply) . 22. All exterior walls except the front wall as shown shall be of two -Your fire- resistive construction without openings if within five feet from the property line, again depending upon use, and with a minimum of one -Your fire-resistive construction in any case except for front wall. 23. Because of the condition of the building, a complete lateral stability analysis by a registered civil or structural engineer will be required. 24. Replace all missing doors, damage, and windows. Provide con- struction plans showing all work to be done (plan- checking). 25. Replace all broken or damaged plumbing fixtures. 26. All roof drainage to be provided on own property - not in two foot section at right side of building. 27. Connect plumbing to public sewer, obtain approval and permits from engineering division for all work in public street (con- nection will be a "Y" in mainline). 28. Install new electrical service and existing wiring must be repaired as needed due to damage and proposed use. 29. Obtain approval from Director of Public Works for moving of building through or on public streets and pay required fees. 30. Second exits may be required which would be almost impossible to obtain due to width of building in relation to width of lot. This will be decided when a determination of proposed use is stated. 31. This building must meet all the requirements of a new building including construction, design, class and size, and value to other nearby buildings. This must be shown on construction plans. 32. Repair damaged stucco and brush coat all exterior stucco in a color approved by Planning Commission. 33. Paint all exterior wood and trim in accordance with Planning Commission approval. 34. Building is not to be set down until foundation is completed and approval to do so is given by building inspector after inspection. 35. Remove any dry rotted or damaged lumber and termite damaged lumber, and replace with sound timbers. -3- Planning Commission Minutes September 19, 1974 36. Plumbing vents shall terminate a minimum of one foot from any vertical surface (including A/C equipment) and at least 3 feet from any property line and 3 feet above any window, door, or air intake. 37. Open Porch is not permitted within 5 feet of property lines and openings within 10 feet (sane occupancies within 20 feet) must be fire rated doors or windows. 38. A/C equipment mounted on roof shall not be visible from adjacent streets or private properties. 39. All on -site drainage, both land and structural, shall be designed and constructed to the satisfaction of the City of Cypress Building Superintendent. The motion was unanimously carried by the following roll call vote: AYES: 33 S: ABSE;Nr : 4 CODMMISSIONERS: Greenwood, Hart, Mullen and Warren 0 COMMISSIONERS: None 0 OOMMISSIONERS: None PUBLIC HEARING RE: CONDITIONAL USE PERMIT #74 -19, THE DOYLE COMPANY: Chairman Warren announced that this was the time and place for the public hearing to consider a proposed conditional use permit to establish, operate and maintain a bowling alley and restaurant including the incidental sale of alcoholic beverages on 3.50 acres of land situated on the westerly side of Valley View 600 feet southerly of Ball Road in the CG- Commercial General Zone. He declared the public hearing open and asked for the staff report. The Planning Director transmitted to the Commission a communication from the applicant which requested a continuance of the public hearing to the October 17, 1974 Planning Commission meeting. The applicant indicated that financial difficulties were the reason for the request. The staff indicated that, if the hearing is continued, the staff will readvertise the hearing and renotify property owners within 300 feet of the subject property. It was moved by Commissioner Hart, seconded by Commissioner Greenwood and unanimously carried to continue the public hearing regarding Conditional Use Permit #74 -19, the Doyle Company, to the October 17 Planning Commission meeting. Consideration of a Revised Plot Plan for Conditional Use Permit #74 -15, Eddie Fischer. The Planning Director reviewed a revised plot plan submitted for a shopping center at the southeast corner of Ball Road and Moody Street which included construction of a one -way alley along the southerly and easterly property boundaries, He indicated that the building area would be reduced by about 1,000 square feet and that the need for a parking variance would be reduced. Chairman Warren inquired if the applicant wished to speak. Mr. Ralph Nielsen, 8615 Katella, Stanton, representing the applicant, outlined reasons why the applicant felt the alley was a necessary feature to secure tenants and financing for the project. Chpirman Warren asked if anyone wished to speak in favor of Conditional Use Permit #74 -15. Mrs. Mary Ann Ayers, 10021 St. Sophia Circle, Cypress, stated she was in favor of the alley and inquired if additional landscaping could be planted along the southerly boundary as additional screening for the single- family houses. Planning Commission Minutes September 19, 1974 Chairman Warren inquired if anyone wished to speak in opposition. There was no one who wished to speak in opposition to Conditional Use Permit #74 -15. The applicant indicated he would be agreeable to relocating the building three feet north and further west to provide for a landscaping strip on the east and south boundary lines and that this would be preferable to constructing a new wall or adding an extension to the existing block wall. The staff stated the additional landscaping could be easily accommodated by adjusting the landscaping requirements on the north property line and the depth of the parking lot. In response to Commissioner Mullen, the staff indicated they would be making a recommendation regarding the use of compact car parking spaces in the parking lot and discussion was held regarding the merits and disadvantages of designating spaces for compact -sized cars. It was moved by Commissioner Hart and seconded by Commissioner Greenwood that the Planning Commission determines that this is a minor modification to Conditional Use Permit #74 -15, that the findings made by the Planning Director at the July 11 public hearing will not be altered, and authorize the Planning Director to grant the modifications requested. The motion was unanimously carried by the following roll call vote: AYES: 4 CDIIMIISSIONERS : Greenwood, Hart, Mullen and Warren NJES: 0 COMMISSIONERS: None ABSENT: 0 ODMVIISSIONERS: None Consideration of a Request by Presley of Southern California for One -Year Extension of Time on Conditional Use Permit #73 -18 and Tentative Tract #8457. The Planning Director reported that the Presley Company was requesting a one -year extension for a condominium project on the south side of Camp Street, east of Walker, since it was unable to start construction prior to the expiration of the use permit. He stated they were in the process of satisfying several of the conditions of approval and that the staff recommends approval of the extension of time. It was moved by Commissioner Mullen, seconded by Commissioner Hart and unani- mously carried to approve a one -year extension of time on Conditional Use Permit #73 -18 and Tentative Tract Map #8457, Presley Company. Review of Memorandum on Procedures for Review of the Zoning Ordinance of the City of Cypress. The Planning Director presented Staff Report PC#74 -41 dated September 13, 1974 regarding procedures for the review of the City Zoning Ordinance. He recommended that the Commission conduct public hearings in order to bring the Zoning Ordinance up to date to include interpretations made by the City Council and Planning Commission and suggestions for modifications or clarifications. The Planning Director recuminended that the Commission authorize the staff to initiate the public hearings to consider amendments to the Zoning Ordinance with the first hearing to be scheduled for October 17. It was moved by Commissioner Hart, seconded by Commission Mullen and unanimously carried to authorize the staff to initiate the public hearings to consider amendments to the Cypress Zoning Ordinance with the first public hearing date to be set for Thursday, October 17. Review of Hcme Occupation Permits Issued from June through August, 1974. The Planning Director presented a report which identified the applicant, nature and conditions attached to all home occupation permits issued for the period June through August, 1974. He stated the staff was in the process of reviewing all home occupation permits to determine which are still valid. -5- Planning Commission Minutes September 19, 1974 It was moved by Commissioner Hart, seconded by Commissioner Greenwood and unanimously carried to receive and file the report regarding hone occupation permits. The Planning Director advised the Commissioners that Commissioner Marshall Ricker had submitted a letter of resignation to the City Council at its September 10 meeting. The Planning Commission requested that the Planning Director draft a resolution of commendation to Mr. Ricker for consideration at the next meeting.
