Resolution No. 5224RESOLUTION NO. 5224 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS, AND ACTING AS THE EX OFFICIO GOVERNING BOARD OF DIRECTORS OF THE CYPRESS RECREATION AND PARK DISTRICT, A SUBSIDIARY DISTRICT OF THE CITY OF CYPRESS, ESTABLISHING THE CITY /DISTRICT'S RECORDS RETENTION AND DESTRUCTION POLICY. WHEREAS, Section 34090 of the Government Code of the State of California, provides for the retention and destruction of records; and WHEREAS, with the passage of SB 742, effective January 2000, Section 12236 was added to the State Government Code, which established a Local Government Records Program to be administered by the State Archives under the Office of the Secretary of State; and WHEREAS, a Local Government Records Retention Guidelines document was developed by the City Clerks Association of California, in cooperation with the Secretary of State's office, which is consistent with the Government Code, and supported by the General Assembly of the League of California Cities, the California Chapter of the American Planning Association, the California Professional Firefighters, and the California State Association of Counties; and WHEREAS, the City /District generate and accumulate a significant volume of records which require the implementation of a uniform City -wide records retention /destruction policy. NOW, THEREFORE, THE CYPRESS CITY COUNCIL, AND ACTING AS THE EX OFFICIO GOVERNING BOARD OF THE CYPRESS RECREATION AND PARK DISTRICT, DO HEREBY RESOLVE AS FOLLOWS: Section 1. The records of the City of Cypress /Cypress Recreation and Park District shall be retained and destroyed as follows: A. The records of the City /District shall be retained in accordance with the "Local Government Records Retention Guidelines," dated August 1999, marked as Exhibit "A ", a copy of which is on file in the office of the City Clerk, and by this reference is incorporated fully herein. B. Records which have been retained for the designated period of time set forth in the "Local Government Records Retention Guidelines" may be destroyed by the Department Head having primary responsibility for the records with the written consent of the City Attorney. C. Records destruction may occur in accordance with Section A. above without further action of the City Council. Section 2. All conflicting Resolutions pertaining to Records retention /destruction are hereby repealed.
