RESOLUTION NO. 4827
A RESOLUTION OF THE CITY OF CYPRESS, CALIFORNIA, TO
RECOGNIZE THE CHANGE IN FIRE SERVICES PROVIDED TO CITY FROM
THE ORANGE COUNTY FIRE DEPARTMENT TO THE ORANGE COUNTY
FIRE AUTHORITY, TO MAINTAIN EXISTING ADMINISTRATIVE
SERVICES UNDER THE ORANGE COUNTY FIRE AUTHORITY, AND TO
CONTINUE CITY PROCESSING FEES THEREFORE, AND REPEAL
RESOLUTION NO. 3943.
WHEREAS, THE CITY OF CYPRESS became a member of the Orange
County Fire Authority pursuant to a "Joint Powers Agreement creating the Orange
County Fire Authority ", effective in the City on March 1, 1995, (the "Agreement ");
WHEREAS the Orange County Fire Authority has independent authority to set
and collect fees for fire services;
WHEREAS, Article IV of the "Agreement" confers upon the Authority the
power to "levy and collect payments and fees for services "; and;
WHEREAS, the Orange County Fire Authority has undertaken studies to revise
their fire prevention fees, which fee revision went into effect on July 1, 1997; and;
WHEREAS, CITY additionally participates in permit assistance and processing
in order to aid applicants requiring planning and development review services from the
Orange County Fire Authority;
WHEREAS, the City of Cypress incurs a cost in order to provide these
processing services;
NOW, THEREFORE, the City Council of the City of Cypress does hereby
resolve as follows:
Section 1. The Joint Powers Agreement created the Orange County Fire
Authority as the successor to the Orange County Fire Department, effective
March 1, 1995, and the City recognizes the right of the Orange County Fire
Authority to set fees for fire services.
Section 2. City will continue to provide administrative permit processing
assistance in order to aid applicants requiring planning and development review
services from the Orange County Fire Authority.
Section 3. The City of Cypress will continue its Fire Prevention Document
Processing Fee at 10% of the amount of the Fire Authority's fees, which is
consistent with the City's cost of processing plans, invoices, and other fire
prevention documents. The City of Cypress shall collect the total fees due the
Orange County Fire Authority plus the City's 10% fee and monies shall be
forwarded to the Orange County Fire Authority in the amount of the applicable
Orange County Fire Authority fee.
Section 4. Resolution No. 3943 is hereby repealed.
PASSED AND ADOPTED by the City Council of the City of Cypress at a
regular meeting held on the 28th day of July , 1997.
