Resolution No. 4849171 RESOLUTION NO. 4849 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS DENYING AMENDMENT TO CONDITIONAL USE PERMIT NO. 92 -15 THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS: 1. That an application was filed for a conditional use permit in accordance with the provisions of Section 17.2 of the Zoning Ordinance of the City of Cypress to expand church operations for office and storage area into commercial lease spaces located at 5307 and 5309 Lincoln Avenue within the CHLC - 10,000 Commercial Heavy Lincoln Avenue Combining Zone. 2. That the City Council, after proper notice thereof, duly held a public hearing on said application as provided by law in which the public was given the opportunity to be heard regarding Amendment to Conditional Use Permit No. 92 -15. 3. That the City Council hereby finds and determines as follows: a. The proposed location of the conditional use is not in accord with the objectives of the Zoning Ordinance and the purpose of the CHLC - 10,000 Commercial Heavy Lincoln Avenue Combining Zone, which is to provide appropriately located areas for establishments catering primarily to highway travelers, visitors to the City or such businesses or uses where direct access to major arterial highways is essential or desirable for their operation. The proposed office and storage use is not a commercial use compatible with the zone in which the site is located, which zone was designed to facilitate commercial uses. b. Pursuant to Cypress City Code Section 17.2 -7, the proposed location of the conditional use is not in accord with the objectives of the Zoning Ordinance and the purpose of the CHLC - 10,000 Commercial Heavy Lincoln Avenue Combining Zone in which the site is located, because the proposed church related use will not promote a revitalization of the commercial areas on Lincoln Avenue and will not enhance the economic base of the City. The proposed office and storage use is not a commercial or commercial service use and will use up lease space designed for commercial uses. c. Pursuant to Cypress City Code Section 17.2 -7, the proposed location of the conditional use is not in accord with the objectives of the Zoning Ordinance and the purpose of the CHLC - 10,000 Commercial Heavy Lincoln Avenue Combining Zone in which the site is located, because the proposed church office and storage use will not strengthen the economic base of the Lincoln Avenue Project Area and will not stimulate new commercial expansion, employment or economic growth. The proposed office and storage use will prohibit the creation of new, or the expansion of, existing commercial uses in the CHLC Commercial Heavy Lincoln Avenue Combining Zone, which zone was designed for commercial uses. d. Pursuant to Cypress City Code Section 17.2 -7, the proposed location of the conditional use is not in accord with the objectives of the Zoning Ordinance and the purpose of the CHLC - 10,000 Commercial Heavy Lincoln Avenue Combining Zone in which the site is located, because the proposed office and storage is an inappropriate location for mixing uses and will result in incompatible uses on the same site. e. Pursuant to Cypress City Code Section 17.2 -7, the proposed location of the conditional use is not in accord with the objectives of the Zoning Ordinance and the purpose of the CHLC - 10,000 Commercial Heavy Lincoln Avenue Combining Zone in which the site is located, because the proposed conversion of the existing commercial lease space to a church office and storage use is not consistent with the goals and policies of the Lincoln Avenue Redevelopment Plan in that the proposed project would not improve the economic viability of the site for the same reasons identified in this resolution. The proposed site is an inappropriate location for mixing uses and will result in incompatible uses on the same site. NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City of Cypress does hereby DENY Amendment to Conditional Use Permit No. 92 -15. 172 PASSED AND ADOPTED by the City Council of the City of Cypress at a regular meeting held on the 8th day of September , 1997.
