RESOLUTION NO. 4937
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS DENYING A
VARIANCE FROM THE TERMS OF THE ZONING ORDINANCE OF THE CITY OF
CYPRESS, SECTION 15.3.C. TO ALLOW PERMANENT BANNER -TYPE SIGNAGE AT
AN EXISTING AUTOMOBILE SALES LOT.
VARIANCE NO. 98 -2
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES,
DETERMINES, AND ORDERS AS FOLLOWS:
1. That an application was filed for a variance from the terms of the Zoning
Ordinance of the City of Cypress, Section 15.3.C, to allow four (4) light -pole- mounted banner
signs on a permanent basis at an existing automobile sales lot located at 9060 Walker Street
within the CG- 10,000 Commercial General Zone.
2. That the City Council, after proper notice thereof, duly held a public hearing on
said application as provided by law.
3. That in accordance with Section 17.3 -7. of the Zoning Ordinance of the City of
Cypress, the City Council hereby finds that:
(a) That strict or literal interpretation and enforcement of the specified
regulation would not result in practical difficulty or unnecessary physical hardship
inconsistent with the objectives of this chapter because, the applicant may display the
subject banner -type signs on a temporary basis for a period of up to fifteen (15) days per
calendar quarter, subject to temporary use permit approval.
(b) That there are no exceptional or extraordinary circumstances or conditions
applicable to the property involved which do not apply generally to other properties in the
same zone because, the subject property is located on a corner lot and is highly visible
from the commercial corridor on Walker Street.
(c) That strict or literal interpretation and enforcement of the specified
regulation would not deprive the applicant of privileges enjoyed by the owners of other
properties in the same zone because, no other businesses located in the CG- 10,000
Commercial General Zone have been granted banner -type sale signage on a permanent
basis.
(d) That the granting of the variance as conditioned would constitute the
granting of a special privilege inconsistent with the limitations on other properties in the
vicinity classified in the same zone because, no other businesses located in the CG- 10,000
Commercial General Zone have been granted banner -type sale signage on a permanent
basis.
(e) That the granting of the variance will not be detrimental to the public
health, safety, or welfare, but may be materially injurious to properties or improvements
in the vicinity, because the granting of the signage variance will detract from the
attractiveness and orderliness of the City's appearance and the surrounding neighborhood.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City
of Cypress does hereby deny Variance No. 98 -2.
PASSED AND ADOPTED by the City Council of the City of Cypress at a regular
meeting held on the 27th day of April , 1998.
