Ordinance No. 898ORDINANCE NO. 898 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS AMENDING SECTION 14.2.B. OF THE APPENDIX I, "ZONING," OF THE CODE OF THE CITY OF CYPRESS THE CITY COUNCIL OF THE CITY OF CYPRESS DOES HEREBY ORDAIN AS FOLLOWS: SECTION I. Section 14.2.B, "Schedule of off - street parking requirements for buildings or uses," Appendix I, "Zoning," of the Code of the City of Cypress is hereby amended to read as follows: Automobile, boat, camper or similar vehicle sales, display or rental uses Automobile car wash Bank, financial institution, public or private utility office Boarding or rooming house Church, chapel, or mortuary Clubs or lodges College, or university, including auditoriums, stadiums and housing Community care facilities Convalescent home /hospital Country club, swim club or recreation use 1 1 space for each 500 square feet of gross floor area, but not less than 5 spaces Spaces or reservoir parking and drying equal to 5 times the capacity of the car wash. 1 space for each 250 square feet of gross floor area. 1 space for each guest room or guest dwelling. 1 space for each 3 seats in the main assembly room; or 1 space for each 20 square feet in the main assembly room. 1 space for each 3 seats in the main assembly room; or 1 space for 20 square feet in the main assembly room. 0.75 space for each full -time equivalent student, less the number of spaces provided for on- campus housing facilities according to this schedule. 0.5 space for bed. 1 space for each 3 patient beds. 1 space for each 3 persons based on the maximum anticipated capacity of all facilities capable of simultaneous use as determined by the Planning Director. 23L 2 ?2 Day /child care center, including nursery schools and preschools Dormitories or other student housing Drive -in dairies Drive -in restaurants Elementary or junior high school Food store, supermarket or similar use General retail and service uses High school, including auditoriums and stadiums on site Hospital Hotel, motel or inn Manufacturing or industrial uses, including office or other incidental operations on the site Medical or dental office Mini -mart Office, administrative, technical service, and similar uses Plant nursery, garden shop 1 space for each staff member plus 1 space for each 10 students; or in the Planned Community (PC) Business Parks, Planned Business Park (PBP) and the Business Park (BP) zones, a parking plan approved by the City Council based on the results of a parking study paid for by the applicant, and conducted by the City or its designee. 1 space for each guest room 5 spaces. 1 space for each 200 square feet of gross floor area, but not less than 10 spaces for each such establishment. 2 spaces for each teaching station. 1 space for each 225 square feet of gross floor area (including display). 1 space for each 250 square feet of gross floor area. 7 spaces for each teaching station. 2 spaces for each patient bed. 1 space for each guest room. 2 parking spaces for each 3 employees, but in no event less than 2 spaces for each 1,000 square feet of gross floor area. 1 space for each 200 square feet. 1 space for each 250 square feet, but a minimum of 5 spaces. 1 space for each 250 square feet of gross floor area. 5 spaces plus 1 additional space for each 1,000 square feet of outdoor sales or display. Recycling collection facilities, including reverse vending machines and mobile recycling units Restaurant, cocktail lounge, or similar use for sale or consumption of food or beverage No additional parking spaces will be required for a recycling facility located at the established parking lot of a host use. However, occupation of parking spaces by the facility and employee attendant may not reduce available parking spaces below the minimum number required for the primary host use unless the facility is located in a convenience zone as designated by the California Department of Conservation Division of Recycling. In that case, a reduction of available parking spaces shall not exceed five (5) spaces. 1 space for each 100 square feet of gross floor area, but not less than 10 spaces for each such establishment. Service station 5 spaces Shopping center or supermarket 1 space for each 225 square feet of gross floor area. Theater or auditorium not on a school site Warehouse and distribution industry 1 space for each 3 seats in main assembly room; or, (without fixed seats) 1 space for each 20 square feet in main assembly room. 2 parking spaces for each 3 employees, but in no event less than 2 spaces for each 1,000 square feet for the first 20,000 square feet; 1 space for each 2,000 square feet for the second 20,000 square feet; 1 space for each 4,000 square feet of floor area of the building area. If there is more than 1 shift, may be used in determining parking requirements. SECTION II. If any section, subsection, subdivision, sentence, clause, phrase, or portion of this Ordinance, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have adopted this Ordinance, and portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases or portions thereof be declared invalid or unconstitutional. SECTION III. The City Clerk is hereby authorized and directed to certify as to the passage of this Ordinance and to give notice thereof by causing copies of this Ordinance to be posted in three public places throughout the City. FIRST READ at a regular meeting of the City Council of said City held on the 12th day of July 1993 and finally adopted and order posted at a regular meeting held on the 26th day of July 1993.
