ORDINANCE NO. 916
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS,
CALIFORNIA AMENDING THE ZONING CODE SECTIONS 8, 10.1.B.,
AND 10.3.B., TO ESTABLISH REQUIREMENTS AND PROCEDURES
FOR THE CONSIDERATION OF SINGLE ROOM OCCUPANCY
DEVELOPMENT
THE CITY COUNCIL OF THE CITY OF CYPRESS DOES ORDAIN AS
FOLLOWS:

SECTION 1: Section 8 of the Zoning Ordinance is hereby amended as follows:
SECTION 8. DEFINITIONS
A. For the purposes of this Ordinance, certain words, phrases, and terms used herein
shall have the meaning assigned to them by this Section.
When not inconsistent with the context, words used in the present tense include the
future; words in the singular number include the plural; and those in the plural number
include the singular. The word "shall" is mandatory; the word "may" is permissive.
Single Room Occupancy Development shall mean a group of guest units where each
unit contains a minimum 175 square feet and is limited to persons of low and very low
income only.

SECTION 2: Section 9.1 and 9.2 of the Zoning Ordinance is hereby amended as
Section 10.1 Permitted and Conditional Uses: Commercial Zones.
The following uses shall be permitted uses where the symbol "P" appears, and shall
be permitted uses subject to a conditional use permit where the symbol "C" appears in the
column beneath each zone designation:

J. The following standards shall be required for all Single Room Occupancy
Housing:
1. All projects shall comply with the most recently adopted City Building,
Plumbing, Mechanical, Electrical, Fire, and Housing Codes.
2. Proposed SRO developments shall require Preliminary Design Review
approval from the Design Review Committee prior to any formal application
submittals.

3. Minimum /maximum room sizes:
Minimum size single occupancy 175 Sq. Ft.
Minimum size double occupancy 275 Sq. Ft.
Maximum size single occupancy 220 Sq. Ft.
Maximum size double occupancy 450 Sq. Ft.
Maximum % double occupancy 10%
4. Parking requirements: .25 spaces per single occupancy unit plus one (1)
space per SRO employee.
5. Each development shall comply with Federal, State, and local laws
regarding access and accommodations for disabled persons.
6. At least one (1) disabled person accessible unit shall be required for every
twenty (20) rooms, and shall comply with all applicable state laws.
7. A Management Plan shall be submitted to the Planning Department for
review and approval as part of the conditional use permit application. Each
Management Plan shall contain information relating to projected staffing needs,
facility management and operations, emergency procedures, security, rental
procedures and proposed rental rates.
8. Each unit shall contain a kitchen and bathroom.
a. Kitchens shall contain a sink with garbage disposal, counter top
(minimum 16" x 24 "), refrigerator, and stove or microwave oven.
b. If stoves are not provided in each unit, then stoves shall be provided in
a common kitchen area(s).
c. Bathrooms shall contain a lavatory, toilet, and shower or bathtub.
9. Each unit shall have a minimum of forty -eight (48) cubic feet of closet /storage
space located within the unit.
10. For developments containing thirty or fewer units, minimum common
open space of four hundred (400) square feet shall be provided. For projects with
more than thirty units, an additional fifteen (15) square feet of open space shall be
required per unit.
11. A single controlled entrance to the SRO development shall be located
adjacent to and in full view of the manager's desk.
12. A mailbox shall be provided for each unit.
13. A secured area for the parking of bicycles shall be provided and be of a
size to accommodate one (1) bicycle for every three (3) units.
14. Each unit shall be provided with a storage unit not less than ten (10) cubic
feet located within the development.
15. Laundry facilities shall be provided in a separate room /rooms and be
located in close proximity to the units served. A minimum of one washer and one
dryer shall be provided for each ten (10) units.
16. A supply storeroom and /or utility closet with at least one (1) laundry tub
with hot and cold water on every floor shall be provided.
17. A centralized trash area shall be provided for each development.
18. Rental units shall be established for both weekly and monthly tenancies
only. Deposit requirements shall be specified for each type of tenancy.
19. Any development containing sixteen (16) or more units shall have a
resident manager available on a 24 -hour basis.
20. The SRO development owner shall be responsible for filing an annual
report to the Department of Planning which includes the range of monthly rents, the
monthly income of residents, occupancy rates, and the number of vehicles owned by
residents.
21. All SRO developments shall be restricted to low and very low income
individuals as defined by the City's existing housing element, with the exception of
the twenty -four (24) hour resident manager.
22. The City Council maintains the right to review the conditional use permit
and may, subject to a public hearing, modify the conditional use permit should
substantiated complaints be received regarding the operation or maintenance of the
facility.
23. All two story SRO developments located adjacent to residentially zoned
property shall be required to maintain a minimum building setback of twenty feet (20').
SECTION 3: If any section, subsection, subdivision, sentence, clause or phrase, or
portion of this Ordinance, is for any reason held to be invalid or unconstitutional by the decision
of any court of competent jurisdiction, such decision shall not affect the validity of the remaining
portions of this Ordinance. The City Council hereby declares that it would have adopted this
Ordinance, and each section , subsection, subdivision, sentence, clause, phrase, or portion
thereof, irrespective of the fact that any one or more sections, subsections, subdivision,
sentences, clauses, phrases, or portions thereof be declared invalid or unconstitutional.
SECTION 4: The City Clerk is hereby authorized and directed to certify as the
passage of this Ordinance and to give notice thereof by causing copies of this Ordinance to be
posted in three public places throughout the City.
FIRST READ at a regular meeting of the City Council of said City held on the 9 th
of May , 1994, and finally adopted and order posted at a regular meeting held on the
23rd day of May, 1994.
