Ordinance No. 9374 O ORDINANCE NO. 937 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS, CALIFORNIA, AMENDING SECTION 23.4.A. "LANDSCAPING REQUIREMENTS," OF APPENDIX I "ZONING" OF THE CODE OF THE CITY OF CYPRESS TO BE CONSISTENT WITH LANDSCAPE REQUIREMENTS CONTAINED IN OTHER CITY ORDINANCES AND IN CITY ADOPTED SPECIFIC PLANS. THE CITY COUNCIL OF THE CITY OF CYPRESS DOES HEREBY ORDAIN AS FOLLOWS: SECTION I. Section 23.4.A. of Appendix I of the Cypress City Code is hereby amended to read as follows: Section 23.4 Landscaping requirements. A. All required landscaped areas, including landscaped areas within parking lots, shall consist of drought tolerant plant material. Landscaping within parking lots shall meet the minimum requirements of Section 14 of the City of Cypress Zoning Ordinance, and subsections L., M., and N. of this Section. All other required landscape areas shall meet the following minimum requirements: 1. One (minimum fifteen - gallon) tree shall be provided for every two hundred (200) square feet of landscaped area. Twenty (20) percent of the required trees shall be twenty -four (24) inch box minimum. The number of required trees may be reduced by the Planning Director when it is determined that an alternative design will meet the intent of subsection D., E., and F. of this Section. All trees shall be staked in accordance with standards maintained by the Public Works Department. 2. One shrub shall be provided for every twenty -five (25) square feet of landscaped area. Fifty (50) percent of the required shrubs shall be a minimum of five (5) gallons. The number of required shrubs may be reduced by the Planning Director when it is determined that an alternative design will meet the intent of subsections D., E., and F. of this Section. 3. At least fifty (50) percent of all landscaped areas containing trees and shrubs shall be underplanted with groundcover, with the remaining areas to incorporate a minimum two inch (2 ") layer of mulch. The Planning Department may, however, approve a landscape plan incorporating less than fifty (50) percent groundcover when it is determined that an alternative design will meet the intent of subsections D., E., and F. of this Section, or that an alternative design is set forth in an approved Specific Plan which has been adopted by City Ordinance. Groundcover shall be approved by the Planning Department. 4. Turf incorporated into the landscape design shall not constitute more than fifty (50) percent of the total landscaping area. The Planning Department may, however, approve a landscape plan incorporating more than fifty (50) percent turf area, providing the turf area serves a usable and beneficial purpose (i. e. active recreation), or the percentage of turf area is set forth in an approved Specific Plan which has been adopted by City Ordinance. Said turf shall be of a drought tolerant variety. Section II. If any section, subsection, subdivision, sentence, clause or phrase, or portion of this Ordinance, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have adopted this Ordinance, and each section, subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivision, sentences, clauses, phrases, or portions thereof be declared invalid or unconstitutional. The City Clerk is hereby authorized and directed to certify as the passage of this Ordinance and to give notice thereof by causing copies of this Ordinance to be posted in three public places throughout the City. FIRST READ at a regular meeting of the City Council of said City held on the 8th day of May 1995, and finally adopted and order posted at a regular meeting held on the 22nd day of May 1995.
