Ordinance No. 725ORDINANCE NO. 725 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS ADDING TO EXEMPTIONS TO SECTION 26 -9.6 RELATING TO SALES AND USE TAXES THE CITY COUNCIL OF THE CITY OF CYPRESS DOES ORDAIN AS FOLLOWS: SECTION _____ 1. Subsections (c) and (d) of Section 26 -9.6 of the Cypress City Code are hereby relettered as subsections (e) and (f) thereof, respectively, and new subsections (c) and (d) of said section are hereby added to read as follows: (c) There are exempted from the com- putation of the amount of the sales tax the gross receipts from the sale of tangible per- sonal property to operators of waterborne vessels to be used or consumed principally outside the city in which the sale is made and directly and exclusively in the carriage of persons or property in such vessels for commercial purposes. (d) The storage, use, or other consump- tion of tangible personal property purchased by operators of waterborne vessels and used or consumed by such operators directly and exclusively in the carriage of persons or property of such vessels for commercial pur- poses is exempted from the use tax. SECTION 2. Severability. If any section, subsection, subdivision, sentence, clause, phrase or portion of this or- dinance, or the application thereof to any person or place, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance or its application to other persons or places. The City Council hereby declares that it would have adopted this ordinance, and each section, subsection, subdivision, sentence, clause, phrase or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sen- tences, clauses, phrases, or portions, or the application thereof to any person or place, be declared invalid or uncon- stitutional. SECTION 3. This Ordinance relates to taxes for the usual and current expenses of the City, and it shall be effective as of March 1, 1984, or, in the event said effective date is determined to be invalid, it shall be effective as of the date of its adoption.
