Ordinance No. 767ORDINANCE NO. 767 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS, CALIFORNIA, RELATING TO REGULATION OF THE PARKING OF VEHICLES THE CITY COUNCIL OF THE CITY OF CYPRESS DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council of the City of Cypress hereby finds and declares as follows: 1. Section 22507 of the California Vehicle Code has been revised to allow local authorities, by ordinance or resolution, to prohibit or restrict the parking or stand- ing of vehicles which are six feet or more in height within 100 feet of any intersec- tion, on certain streets or highways, or portions thereof, during all or certain hours of the day, provided that signs or markings giving adequate notice of the prohibition or restriction have been placed. Such regulation is desirable, for safety reasons, to give motorists adequate protected sight - distance at non - signalized intersections. Accordingly, the Cypress Municipal Code is amended as follows: SECTION 2. Title 16 is hereby amended to add Section 16 -55.1 to read as follows: "Section 16 -55.1: No person who owns or has possession, custody or control of any vehicle which is six feet or more in height (including any load thereon) shall park or leave standing any such vehicle on a street or highway within one hundred (100) feet of any intersection,,at any location at which such prohibition is indicated by appropriate signs giving notice thereof. Vehicles found in violation of this section may be cited in accordance with the provisions of subparagraph (e) of Section 16 -23." SECTION 3. If any section, subsection, subdivision; sentence, clause, phrase, or portion of this Ordinance, or the apllication thereof to any person or place, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance or its application to other persons or places. The City Council hereby declares that it would have adopted this Ordinance and each section, subsection, subdivision, sentence, clause, phrase or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions, or the application thereof to any person or place, be declared invalid or unconstitutional. SECTION 4. The City Clerk is hereby authorized and directed to certify as to the passage of this Ordinance and to give notice thereof by causing copies of this Ordinance to be posted in three public places throughout the City. FIRST READ. at the regular meeting of the City Council of said City held on the 14th day of October 1986, and finally adopted and ordered posted at a regular meeting held on the 27th day of October 1986.
