AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS
ENACTING A ZONING MORATORIUM ON HOTEL /MOTEL BUSINESSES
IN THE CH- 10,000 ZONE.
WHEREAS, the City Council of the City of Cypress ordains as follows:
SECTION 1. New hotel /motel uses, as defined herein, are hereby pro-
hibited within the CH- 10,000 zone in the City during the term of this interim
Ordinance and any extensions thereof.
"Hotel /motel," as used in this Ordinance, shall mean a structure or a
portion thereof or a group of attached or detached structures containing
completely furnished individual guest rooms or suites occupied on a transient,
temporary basis for compensation. A "new hotel /motel" shall mean a hotel/
motel with respect to which discretionary land use approval has not been
granted prior to the date of this interim Ordinance.
SECTION 2. This interim Ordinance is adopted as an urgency measure to
prohibit any uses in the CH- 10,000 zone which may be in conflict with a contem-
plated zoning proposal concerning hotel /motel uses which the legislative body
is considering or studying or intends to study within the term of this Ordi-
nance. This Ordinance shall be of no further force and effect forty -five (45)
days from the date of its adoption unless extended pursuant to Government Code
Section 65858. Any conditional use permits for hotel /motel uses within the
CH- 10,000 zone granted to date by the City Council are hereby exempt from the
provisions of this Ordinance.
SECTION 3. The City Council finds that there is a current and immediate
threat to the public health, safety, or welfare, and that the approval of
additional subdivisions, zonings, land use permits, variances, building per-
mits, or any other applicable entitlement for use which is required in order
to comply with the Zoning Ordinance would result in a threat to public health,
safety, or welfare, in that the City is currently considering upgrading its
regulations regarding the location of and standards for hotel /motel uses in
the CG- 10,000 zone; the unregulated establishment of new hotel /motel uses
within the CH- 10,000 zone in the City would result in a threat to public
health, safety, or welfare; and a reasonable time is needed for the City to
study appropriate zoning classifications and regulations for hotel /motel uses.
SECTION 4. This Ordinance shall require four (4) affirmative votes and
shall take effect immediately upon adoption.
PASSED AND ADOPTED at a regular meeting of the City Council of the City
of Cypress on the 9th day of March 1987.
