ORDINANCE NO. 771
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS
AMENDING SECTION 9.2 PROPERTY DEVELOPMENT STANDARDS: RESIDENTIAL ZONES;
SECTION 9.3 PERFORMANCE STANDARDS: RESIDENTIAL ZONES:
SECTION 16.1 LACK OF OFF- STREET PARKING; AND SECTION 17.7 ADJUSTMENTS;
OF ORDINANCE NO. 640, THE ZONING ORDINANCE OF THE CITY OF CYPRESS,
KNOWN AS AMENDMENT TO THE ZONING ORDINANCE NO. 87 -1.
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY DOES ORDAIN AS FOLLOWS:
SECTION 1. Sub - Section B., General Requirements of Section 9.2, Property
Development Standards: Residential Zones, of Ordinance No. 640, the Zoning
Ordinance of the City of Cypress (hereinafter referred to as the "Zoning Ordi-
nance") is amended to to read as follows:

SECTION 2. Section 9.3 Performance Standards: Residential Zones, of the
Zoning Ordinance, is amended to read as follows:
F. In any Residential Single - Family Zone, additions to the original
permitted dwelling shall be permitted within the required side yard
setback area provided that the setback distance between the addition
and the interior side property line is the same or greater than that
of the original dwelling. Garages and other accessory structures
shall not be used to justify a reduced side yard setback. In
addition, room additions shall not be located closer than five feet
(5') from an interior side property line except as provided in
Section 17.7 -1.K.
SECTION 3. Section 16.1., Lack of Off- Street Parking, of the Zoning Ordi-
nance, is amended to read as follows:
SECTION 16.1. EXCEPTIONS TO NONCONFORMING STATUS
A. No existing use of land or structure shall be deemed nonconforming
solely because of the lack of off - street parking required by this
Ordinance.
B. No residential dwelling shall be deemed nonconforming solely
because it does not meet required side yard setbacks, provided
it complies with the side yard setback requirements in effect
at the time a building permit was issued for its construction.
SECTION 4. Section 17.7 -1, Purpose and Authority, of the Zoning Ordinance,
is amended to read as follows:
K. A decrease in the required interior side yard setback to a
minimum of three feet (3') for the purpose of constructing a
room addition to the original permitted dwelling in the RS -6,000
or RS- 15,000 Residential Single - Family Zones. The setback
distance between the addition and the interior side property
line shall be the same or greater than that of the original
dwelling. Garages and other accessory structures shall not
be used to justify a reduced side yard setback.

SECTION 5. If any section, subsection, subdivision, sentence, clause,
phrase, or portion of this Ordinance, or the application thereof to any person
or place, is for any reason held to be invalid or unconstitutional by the
decision of any court of competent jurisdiction, such decision shall not affect
the validity of the remaining portions of this Ordinance or its application to
other persons or places. The City Council hereby declares that it would have
adopted this Ordinance, and each section, subsection, subdivision, sentence,
clause, phrase or portion thereof, irrespective of the fact that any one or more
sections, subsections, subdivisions, sentences, clauses, phrases, or portions,
or the application thereof to any person or place, be declared invalid or
unconstitutional.
SECTION 6. The City Clerk is hereby authorized and directed to certify
as to the passage of this Ordinance and to give notice thereof by causing copies
of this Ordinance to be posted in three public places throughout the City.
FIRST READ at a regular meeting of the City Council of said City held on
the 9th day of March 1987, and finally adopted and ordered posted at a regular
meeting held on the 23rd day of March 1987.
