Ordinance No. 775ORDINANCE NO. 775 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS REGARDING PERFORMANCE STANDARDS WITHIN ALL COMMERCIAL ZONES AND OTHER MATTERS RELATING THERETO. THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY DOES ORDAIN AS FOLLOWS: SECTION 1. Section 7(D) of the Zoning Ordinance of the City of Cypress is hereby amended to read as follows: D. Penalties Any person, firm or corporation, whether as principal, agent, employee or otherwise, violating any provisions of this ordi- nance or violating or failing to comply with any other or regulation made hereunder, shall be guilty of a misdemeanor, unless such provision expressly provides that the violation thereof is an infraction, and, upon conviction of such misde- meanor, shall be punishable as provided by a fine of not more than five hundred dollars ($500.00), or by imprisonment in the county or city jail for a period of not more than six (6) months, or both such fine and imprisonment. Violators of any infraction hereunder shall be fined in accordance with the following schedules: First violation: $ 75.00 Second violation: $150.00 Third and each subsequent violation shall be deemed to be a misdemeanor and shall be punishable as described above. Citation power will be designated in a resolution. SECTION 2. Section 10.1, Permitted and Conditional Uses, of Ordinance No. 640, the Zoning Ordinance of the City of Cypress is hereby amended to read as follows: E.2. New Section 10.7 of the Zoning Ordinance of the City of Cypress is hereby enacted to read as follows: SECTION 10.7 PERFORMANCE STANDARDS: ALL COMMERCIAL ZONES A. Mechanical devices associated with the cleaning and mainte- nance of real property, including but not limited to pumps, fans, compressors, generators, blowers and sweepers when used for the cleaning and maintenance of property, whether stationary or mobile, may be used within all commercial zones during the hours of 7 a.m. to 8 p.m. on weekdays and the hours of 9 a.m. to 8 p.m. on weekends and on federal holidays. The use of such devices for such purposes at all other times is prohibited. B. No commercial trucks shall be parked overnight on a site within any commercial zone unless a conditional use permit authorizing such use has been granted for such site. C. Trash collection within any commercial zone shall occur between the hours of 6 a.m. to 8 p.m. on weekdays and 10 a.m. to 7 p.m. on weekends and on federal holidays. All other times are pro- hibited. Violations of each of these provisions shall be deemed to be an infraction hereunder and shall be punishable in accordance with the terms of. Section 7 hereof. SECTION 4. Severability. If any section, subsection, subdivision, sentence, clause, phrase or portion of this ordinance, or the application thereof to any person or place, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance or its application to other persons or places. The City Council hereby declares that it would have adopted this ordinance, and each section, subsection, subdivision, sentence, clause, phrase or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions, or the application thereof to any person or place, be declared invalid or unconsti- tutional. SECTION 5. The City Clerk is hereby authorized and directed as to the passage of this ordinance and to give notice thereof by of this ordinance to be posted in three public places throughout FIRST READ at a regular meeting of the City Council of said the llth day of May 1987, and finally adopted and ordered posted meeting of said Council held on the 26th day of May 1987.
