AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS
AMENDING SECTIONS 8.A AND 14.2.A.4 OF ORDINANCE NO. 640,
OF THE ZONING ORDINANCE OF THE CITY OF CYPRESS,
KNOWN AS AMENDMENT TO THE ZONING ORDINANCE NO. 87 -8.
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY DOES ORDAIN
AS FOLLOWS:
SECTION 1. Section 8.A, Definitions of Ordinance No. 640,
the Zoning Ordinance of the City of Cypress, is hereby amended to
read as follows:
SHARED PARKING shall mean the provision of parking spaces
to meet the combined peak parking needs of more than one
use on a lot or on abutting lots.
SECTION 2. Section 14.2.A.4, Off - street Parking, of
Ordinance No. 640, the Zoning Ordinance of the City of Cypress,
is hereby amended to read as follows:
4. All required off - street parking shall be located on the same
lot as the use to be served,, except as provided in this section.
EXISTING
a. In the BP- 20,000 Business Park Zone, off - street parking
spaces may be permitted offsite as an accessory use subject
to Design Review if located within 300 feet of the primary
site. In addition, offsite parking spaces located between
300 to 600 feet from the primary site may be permitted
subject to a conditional use permit. Accessory parking lots
located further than 600 feet from the lot with the use to be
served is prohibited. Any offsite parking shall be subject
to an Affidavit of Nonserverance approved in form and
substance by the City Attorney and Planning Director. The
approved Affidavit of Nonseverance shall be recorded with the
Orange County Recorder's Office and shall run with the land.
b. In any commercial zone or the Public Semi- Public Zone, a
church which does not have sufficient off - street parking
spaces on its own site as required by this Code, may be
permitted subject to a conditional use permit. The Planning
Agency may, at its discretion, approve, conditionally
approve, or deny the conditional use permit.
c. Any shared parking shall be subject to a condition that
the church shall obtain a reciprocal easement or enter into
an agreement with an adjacent property owner. Each proposed
shared parking plan must include are alternate plan should the
shared parking agr_eernent be cancelled. If the shared parking
agreement is terminated by any party for any reason, the
applicant shall provide a minimum of 90 days notice to the
City Planning Department.. At that time the alternate plan
would be implemented. Such a plan may include a shuttle
service between the church and offsite parking spaces.
SECTION 3. If any section, subect i on, subdivision, sentence,
clause, phrase, or portion of this Ordinance, or the application
thereof to any person or place, is for any reason held to be
invalid or unconstitutional by the decision of any court of
competent jurisdiction, such decision shall not affect the
validity of the remaining portions of this Ordinance or its
application to other persons or places. The City Council hereby
declares that it would have adopted this Ordinance, and each
section, subsection, subdivision, sentence, clause, phrase or
portion thereof, irrespective of the fact that any one or more
sect ions, subsections, subdivisions, sentences, clauses, phrases,
or portions, or the application thereof to any person or place,
be declared invalid or unconstitutional.
SECTION 4. The City Clerk is hereby authorized and directed
to certify as to the passage of this Ordinance and to give notice
thereof by causing copies of this Ordinance to be posted in three
public places throughout the City.
FIRST READ at a regular meeting of the City Council of said
City held on the 23rd day of November 1987, and finally adopted
and ordered posted at a regular meeting held on the 14th day of
December 1987.
