Ordinance No. 796ORDINANCE NO. 796 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS AMENDING ORDINANCE NO. 773 ENACTING A ZONING MORATORIUM ON HOTELS /MOTELS IN THE CH- 10,000 COMMERCIAL HEAVY ZONE BY EXTENDING THE TERM FOR A PERIOD OF ONE YEAR THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY DOES ORDAIN AS FOLLOWS: SECTION 1. The term of Ordinance No. 773 shall be extended for a period of one year, with the extended ten -month and fifteen -day term expiring upon adoption of this Ordinance, pursuant to the provisions of Government Code Section 65858. SECTION 2. The extension of this Ordinance is adopted as an urgency measure to prohibit any uses in the CH- 10,000 Zone which may be in conflict with a contemplated general plan, specific plan or zoning proposal concerning hotel /motel uses which the legislative body is considering or studying or intends to study within the extended term of this Ordinance. This Ordinance shall be of no further force and effect one year after the date of its adoption. Any conditional use permits for hotel /motel uses within the CH- 10,000 Zone granted to date by the City Council are hereby exempt from the provisions of this Ordinance. SECTION 3. In adopting the extension of this Ordinance as an urgency measure, the City Council does hereby make the following findings of fact: a. That hotel /motel rooms in the CH- 10,000 Zone are often occupied as long -term residences and not on a transient, temporary basis as defined in Section 8 of the Zoning Ordinance of the City of Cypress; b. That there is a lack of overnight visitors in the area seeking transient accommodations and the construction of additional hotels /motels reduces the demand for overnight accommodations in existing hotels /motels causing these rooms to be rented as long- term residences; c. That hotel /motel rooms in the CH- 10,000 Zone which are occupied as long -term residences often do not contain adequate facilities for the cooking and preparing of meals; d. That overcrowded conditions may exist in the rooms of long -term occupants of hotel /motel rooms; e. That hotels /motels in the CH- 10,000 Zone occupied by families as long -term residences lack adequate open space for recreational purposes threatening the safety of children who play in the parking lots and on the sidewalk adjacent to Lincoln Avenue, a major arterial street. SECTION 4. The City Council further finds that the following measures have been taken to alleviate the condition which led to the adoption of Ordinance No. 773: a. At the City Council meetings of April 28, 1986 and June 9, 1986, the Council received reports from staff on preliminary research to identify the issues relating to hotels /motels in the CH- 10,000 Zone. b. The City Council has combined the study of hotel /motel development in the CH- 10,000 Zone with a study of land use and development of properties along the Lincoln Avenue Corridor. c. The City ot Cypress sponsored a series of four public meetings to discuss issues affecting the Lincoln Avenue Corridor, including the appropriateness of residential uses, and to develop goals for the maintenance of existing and future development along the Corridor. d. Based upon the study of land use and development ot properties along the Lincoln Avenue Corridor, and upon the goals developed at the public meetings, additional zoning classifications, regulations and amendments to City Code will be developed. SECTION 5. Based upon these findings of fact, the City Council has concluded that there is a current and immediate threat to the public health, safety, or welfare; that approval of additional subdivisions, use permits, variances, building permits or any other applicable entitlements tor use which is required in order to comply with a zoning ordinance would result in a threat to public health, safety, or welfare; and that an additional reasonable time is needed for the City to further study appropriate zoning classifications and regulations for hotel /motel uses.
