ORDINANCE NO. 831
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF CYPRESS AMENDING SECTION 10.7 OF
APPENDIX 1, "ZONING," OF THE CODE OF THE CITY
OF CYPRESS RELATIVE TO COMMERCIAL ZONES AND
NOISE STANDARDS THEREOF
THE CITY COUNCIL OF THE CITY OF CYPRESS DOES ORDAIN AS
FOLLOWS:
SECTION I. Section 10.7(B), "Performance
Standards; All Commercial Zones," of Appendix I, "Zoning," of the
Code of the City of Cypress are hereby amended to read as
follows:
"B. No commercial vehicle shall be parked between the
hours of 10:00 p.m. and 7:00 a.m. weekdays and
Saturdays nor between the hours of 8:00 p.m. to 7:00
a.m. on Sundays and federal holidays on any site within
any commercial zone unless a Conditional Use Permit
authorizing such use has been granted for that site."
SECTION II. Section 10.7, "Performance Standards;
All Commercial Zones," of Appendix I, "Zoning," of the Code of
the City of Cypress is hereby amended by the addition of
Subsection "D," "E," and "F" to read as follows:
"D. Deliveries to any site within a commercial zone
shall be prohibited between the hours of 10:00 p.m. and
7:00 a.m. daily, and deliveries shall be prohibited on
Sundays and federal holidays from 10:00 p.m. to
9:00 a.m., unless a conditional use permit authorizing
such use has been granted for the site.
E. No commercial vehicle shall be operated, parked,
stored, or otherwise used in violation of Section 13 -68
et seq. of the Code of the City of Cypress in any
commercial zone in the City.
F. Definitions. For the purposes of this Section,
the following definitions shall apply where these terms
are used:
(1) "Commercial Vehicle" shall mean any vehicle
classified by the State of California as a
commercial vehicle pursuant to Vehicle Code § 260
and which weighs three (3) tons, (6,000 pounds),
or more.
(2) "Delivery" or "Deliveries" shall include the
loading, unloading, or parking of a commercial
vehicle."
SECTION III. If any section, subsection,
subdivision, sentence, clause, phrase, or portion of this
Ordinance is for any reason held to be invalid or
unconstitutional by the decision of any court of competent
jurisdiction, such decision shall not affect the validity of the
remaining portions of this Ordinance. The City Council hereby
declares that it would have adopted this Ordinance, and each
section, subsection, subdivision, sentence, clause, phrase, or
portion thereof, irrespective of the fact that any one or more
sections, subsections, subdivisions, sentences, clauses, phrases
or portions thereof be declared invalid or unconstitutional.
SECTION IV. The City Clerk is hereby authorized and
directed to certify as to the passage of this Ordinance and to
give notice thereof by causing copies of this Ordinance to be
posted in three public places throughout the City.
FIRST READ at a regular meeting of the City Council of
said City held on the 9th day of October , 1989 and finally
adopted and order posted at an adjourned regular meeting held on the
30th day of October 1989.
