ORDINANCE NO. 653
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF CYPRESS AMENDING SECTION 20 -6
OF THE CYPRESS CITY CODE RELATING TO
LOST, ABANDONED OR UNCLAIMED PROPERTY
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY DOES ORDAIJI
AS FOLLOWS:
SECTION 1. Section 20 -6 of the Cypress City Code hereby
is amended to read as follows:
If any lost, abandoned or unclaimed property with the
reported value of Fifty Dollars ($50.00) or more remains
unclaimed and unrestored for ninety (90) days, the
Chief of Police shall cause notice of the property to
be published at least once in a newspaper of general
circulation. If after seven (7) days following the
first publication of the notice, no owner appears and
proves his ownership of the property, and the person
who found or saved the property pays the cost of pub-
lication, the title shall vest in the person who found
or saved the property, unless the property was found in
the course of employment by an employee of any public
agency in which case the property shall be sold at
public auction. Title to the property shall not vest
in the person who found or saved the property or in the
successful bidder at the public auction unless the cost
of publication is first paid to the CitY. If any lost,
abandoned or unclaimed property with the reported value
of less than Fifty Dollars ($50.00) remains unclaimed
and unrestored for ninety (90) days, the title shall
vest in the person who found or saved the property,
unless the property was found in the course of employ-
ment by an employee of any public agency, in which case
the property shall be sold at public auction.
SECTION 2. Severability. If any section, subsection,
subdivision, sentence, clause, phrase or portion of this
Ordinance, or the application thereof to any person or price,
is for any reason held to be invalid or unconstitutional by
the decision of any court of competent jurisdiction, such
decision shall not affect the validity of the remaining por-
tions of this Ordinance or its application to other persons
or places. The City Council hereby declares that it would
have adopted this Ordinance, and each section, subsection,
subdivision, sentence, clause, phrase or portion thereof,
irrespective of the fact that any one or more sections, sub-
sections, subdivisions, sentences, clauses, phrases, or
portions, or the application thereof to any person or place,
be declared invalid or unconstitutional.
168 SECTION 3. The City Clerk is hereby authorized and
directed to certify as to the passage of this ordinance and
to give notice thereof by causing copies of this ordinance
to be posted in three public places within the City.
FIRST READ at a regular meeting of the City Council of
said City held on the 28th day of January 1980 , and
finally ordered published at a regular meeting of said Council
held on the llth day of February 1980
