Ordinance No. 668212 r ORDINANCE NO. 668 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS AMENDING VARIOUS SECTIONS OF ORDINANCE NO. 640, THE ZONING ORDINANCE OF THE CITY OF CYPRESS. THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY DOES ORDAIN AS FOLLOWS: SECTION I. Section 8 of Ordinance No. 640, the Zoning Ordinance of the City of Cypress, is hereby amended to read as follows: HOTEL /MOTEL shall mean a structure or portion thereof or a group of attached or detached structures containing completely furnished individual guest rooms or suites occupied on a transient, temporary basis for compensation. Hotels and motels may provide a maximum of 40% of the total number of units with kitchen facilities. SECTION II. Section 9.3.A of Ordinance No. 640, the Zoning Ordinance of the City of Cypress, is hereby amended to read as follows: In all residential zones, air conditioners, heating, cooling, ventilating equipment, swimming pool pumps and heaters and all other mechanical devices, with the exception of solar collector panels and associated plumbing, shall be located within the rear yard area or street side yard of a corner lot. Such equipment shall be screened from surrounding properties and streets and so operated that they do not disturb the peace, quiet and comfort of neighboring residents, in accordance with the City's Noise Ordinance. Solar collector panels and associated plumbing may be roof top surface mounted in public view provided that associated plumbing shall be painted to match the roof surface color. SECTION III. Section 9.6 of Ordinance No. 640, the Zoning Ordinance of the City of Cypress, is hereby amended to read as follows: A wall or fence not more than six feet (6') in height as measured from the highest adjacent grade, may be maintained along the side or rear lot lines; provided that such wall or fence does not extend into a required front yard. SECTION IV. Section 10.1.B.37 of Ordinance No. 640, the Zoning Ordinance of the City of Cypress, is hereby amended to read as follows: OP -10000 CN -10000 CG -10000 CH -10000 37. Liquor Stores - C C C SECTION V. Section 11.0 of Ordinance No. 640, the Zoning Ordinance of the City of Cypress, is hereby amended to read as follows: BP- 20,000 BUSINESS PARK ZONE This zone is intended as an area for modern industrial /commercial development which meets the high performance and development standards of the City. SECTION VI. Section 11.1.A of Ordinance No. 640, the Zoning Ordinance of the City of Cypress, is hereby amended to add the following: BP -20000 ML -10000 18. Waste paper and aluminum can recycling center transfer station - C SECTION VII. Section 11.1.B of Ordinance No. 640, the Zoning Ordinance of the City of Cypress, is hereby amended to read as follows: BP -20000 ML -10000 Warehouse and Product Distribution Land Uses C P SECTION VIII. Section 11.1.0 of Ordinance No. 640, the Zoning Ordinance of the City of Cypress, is hereby amended to add the following: ti+ BP -20000 ML -10000 22. Planned retail commercial shopping centers consisting of not less than 10 acres in area C SECTION IX. Section 11.3 of Ordinance No. 640, the Zoning Ordinance of the City of Cypress, is hereby amended to add the following: K. All manufacturing operations shall be performed or carried out entirely within an enclosed building and operated in such a manner which will not be detrimental tc adjoining properties. SECTION X. Section 11.6.B of Ordinance No. 640, the Zoning Ordinance of the City of Cypress, is hereby amended to read as follows: In any required rear or interior side yard area, a wall or fence shall not exceed eight feet (8 °) in height as measured from the highest adjacent grade. SECTION XI. Section 12.4 -2 of Ordinance No. 640, the Zoning Ordinance of the City of Cypress, is hereby amended to add the following: R. Day nurseries and nursery schools C S. Churches C T. Clubs and lodges, including YMCA and YWCA, veteran organizations, and other similar non - profit group users C U. Public libraries and museums C V. Temporary uses P (Permitted) 1. Temporary uses as prescribed in Section 13.1 SECTION XII. Section 13.1.1 of Ordinance No. 640, the Zoning Ordinance of the City of Cypress, is hereby amended to read as follows: All temporary uses shall be subject to the issuance of a temporary use permit by the Planning Director. In the issuance of such a permit, the Planning Director shall indicate the permitted hours of operation and other conditions, such as walls or fences, signs and lighting, which are deemed necessary to reduce possible detrimental effects to surrounding developments and to protect the public health, safety and. welfare. The Planning Director shall only issue a temporary use permit if he finds that the proposed use will not be detrimental to surrounding property owners or their health, safety and welfare, otherwise said permit shall be denied. However, the Planning Director may at his option refer the permit application to the planning agency for disposition of the request. Prior to the issuance of a permit for a temporary use, a cash bond shall be deposited with the Finance Department for those uses listed in Section 13.1. This deposit shall be used to defray the costs of cleanup of the property by this City in the event the permitee fails to do same. 13 SECTION XIII. If any section, subsection, subdivision, sentence, clause, phrase, or portion of this Ordinance, or the application thereof to any person or place, is for any reason held to be invalid or unconstitutional by the decision of any court or competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance or its application to other persons or places. The City Council hereby declares that it would have adopted this Ordinance, and each section, subsection, subdivision, sentence, clause, phrase or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions, or the application thereof to any person or place, be declared invalid or unconstitutional. 214 SECTION XIV. The City Clerk is hereby authorized and directed to certify as to the adoption of this Ordinance and to cause copies hereof to be posted in three public places throughout the City. FIRST READ at a regular meeting of the City Council of said City held on the 22nd day of September 1980, and finally adopted and ordered posted at a regular meeting of said Council held on the 14th day of October 1980.
