ORDINANCE NO. 706
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CYPRESS AMENDING SECTION 5 -2 OF THE CYPRESS CITY
CODE,. THEREBY AMENDING BY REFERENCE THE UNIFORM
BUILDING CODE, 1979 EDITION, AND THE UNIFORM FIRE
CODE, 1979 EDITION
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY DOES ORDAIN
AS FOLLOWS:
SECTION 1. Findings. The City of Cypress is a primarily
residential community, and the majority of fires, fire in-
juries, and fire losses within the City are attributable to
residential fires. The amount of fire injuries and fire losses
can be significantly reduced through the use of smoke detec-
tors. Therefore, local conditions within the City of Cypress
and the public health, safety, and general welfare, require
that smoke detectors be provided in residential structures.
SECTION 2. Section 5 -2(A) of the Cypress City Code hereby
is amended by adding thereto the following:
(8) Section 1210(a) is amended by adding thereto the
following: When there is a change in ownership in existing
Group R, Division 1 and 3 occupancies, the entire building
shall be provided with smoke detectors located as required
for new Group R, Division 1 and 3 occupancies. Seller
shall provide a certificate of compliance prior to close of
escrow.
(9) Section 1215 is amended by adding thereto a sub-
section (n) to read as follows:
(n) In all existing Group R, Division 1 occu-
pancies the entire building shall be provided with
smoke detectors approved by the State Fire Marshall,
located as required for a new Group R, Division 1
occupancies, within six months from the adoption of
this provision. Such smoke detectors may be battery
operated when installed in existing buildings or in
buildings without commercial power.
SECTION 3. Section 5 -2(D) of the Cypress City Code hereby
is amended by adding the following:
(8) Section 10.307 hereby is amended by adding sub-
sections (e), (f) and (g) to read as follows:

(e) Fire Warning Systems
(1) Every existing dwelling unit within an
apartment house and every existing guest room in a hotel
used for sleeping purposes shall be provided with state
fire marshall approved smoke detectors. In dwelling units,
detectors shall be mounted on the ceiling or wall at a
point centrally located in the corridor or area giving
access to rooms used for sleeping purposes. In an effi-
ciency dwelling unit, hotel sleeping rooms and in hotel
suites, the detector shall be centrally located on the
ceiling of the main room or hotel sleeping room.
Where sleeping rooms are on an upper 1 v51, 299
detector shall be placed at the center of the 'l c eli ling
directly above the interior stairway. All detectors shall
be located in accordance with approved manufacturer's
instructions. When actuated, the detector shall provide an
alarm in the dwelling unit or guest room.
(2) When alterations, repairs or additions
requiring a permit and having a valuation in excess of
$1,000 occur, or when one or more sleeping rooms are added
or created in existing single family occupancies, the
entire building shall be provided with smoke detectors
located as required for new Group R, Division 3 Occupancies.
(3) Smoke detectors may be battery operated when
installed in existing buildings, or in buildings without
commercial power, or in buildings which undergo altera-
tions, repairs or additions regulated by (e)(2) of this
section.
(f) When there is a change in ownership in existing
Group R, Division 3 Occupancies, the entire building shall
be provided with smoke detectors located as required for
New Group R, Division 3 Occupancies as required in the
Uniform Building Code, 1979 Edition. Seller shall provide
a certificate of compliance prior to close of escrow.
(g) In all existing Group R, Division 1 Occupancies
the entire building shall be provided with smoke detectors
located as required for New Group R, Division 1 Occupancies
within six months from the adoption of this provision.
Smoke detectors may be battery operated when installed in
existing buildings.
SECTION 4. Severability. If any section, subsection, sub-
division, sentence, clause, phrase or portion of this ordi-
nance, or the application thereof to any person or place, is
for any reason held to be invalid or unconstitutional by the
decision of any court of competent jurisdiction, such decision
shall not affect the validity of the remaining portions of this
ordinance or its application to other persons or places. The
City Council hereby declares that it would have adopted this
ordinance, and each section, subsection, subdivision, sentence,
clause, phrase or portion thereof, irrespective of the fact
that any one or more sections, subsections, subdivisions, sen-
tences, clauses, phrases, or portions, or the application
thereof to any person or place, be declared invalid or uncon-
stitutional.
SECTION 5. The City Clerk is hereby authorized and
directed to certify as to the passage of this ordinance and to
give notice thereof by causing copies of this ordinance to be
posted in three public places throughout the City.
FIRST READ at a regular meeting of the City Council of said
City held on the 25th day of April , 1983, and finally
adopted and ordered posted at a regular meeting of said Council
held on the 9th day of May , 1983.
