Ordinance No. 550ORDINANCE NO. 550 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS ADDING ARTICLE VIII TO CHAPTER 2 OF THE CODE OF THE CITY OF CYPRESS ESTABLISHING AN INDUSTRIAL AND COMMERCIAL DEVELOPMENT COMMISSION. THE CITY COUNCIL OF THE CITY OF CYPRESS DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Article VIII, entitled "Industrial and Commercial Develop- ment Commission," hereby is added to Chapter 2 of the Code of the City of Cypress to read as follows: ARTICLE VIII INDUSTRIAL AND COMMERCIAL DEVELOPMENT COMMISSION Sec. 2 -80. Creation. In order to seek and attract industry and commerce to the City, there is created hereby an Industrial and Com- mercial Development Commission as provided herein. Sec. 2 -81. Composition and Appointment of Members. The Indus- trial and Commercial Development Commission shall consist of nine members, including the City Manager, the Manager of the Cypress Chamber of Commerce, a member of the City Council to be determined by the Mayor, and a member of the Board of Directors of the Cypress Chamber of Commerce, to be selected by said Board. These four shall recommend to the City Council the names of individuals to fill the remaining positions on the Commission. The City Council shall appoint the remaining members of the Commission based upon the aforesaid recommendation; provided, however, that the remaining members shall include at least one representative from one of the major public utilities serving the City. Sec. 2 -82. Oath of Office. All members of the Industrial and Commercial Development Commission shall be required to take an oath of office as approved by the City Council prior to commencing their term of office. Sec. 2 -83. Term of Office. The term of office of the members of the Industrial and Commercial Development Commission shall be for a term of four years; provided, however, that any person who is a member of said Commission by reason of his holding one of the positions mentioned in Section 2 -81 shall cease to be a member of the Commission at such time as he ceases to hold such position, and, further provided that the Com- mission members representing the City Council and the Chamber of Commerce Board of Directors shall serve at the pleasure of the body appointing them to the Commission. Sec. 2 -84. Removal. If a member of the Industrial and Commercial Development Commission shall be absent from three consecutive meetings of the Commission without cause, the office of such member shall be vacant and the term of such member terminated, and the City Clerk shall immediately inform the City Council of such termination. An absence due to illness or unavoidable absence from the City and written notice with explanation thereof to the City Clerk on or before the day of any regular meeting of the Commission shall be absence for cause. The City Council may remove any member of the Commission appointed by it at any time and without cause. Sec. 2 -85. Meetings. The Industrial and Commercial Development Commission shall meet regularly at least once each month in the Council Chambers of the City of Cypress, except as otherwise provided by law. Special meetings may be called by the chairman or by a majority of the members of the Commission. All meetings shall be open to the public except as otherwise authorized by law. Regular minutes of such meetings shall be maintained by the Commission and available for public inspection. 2 Sec. 2 -86. Organization. The Industrial and Commercial Development Commission shall elect one of its members as chairman and one of its members as vice - chairman; the chairman and vice - chairman shall hold office for one year and until their respective successors are chosen. The Commission shall establish such rules and regulations as it deems necessary for governing itself, and for the performance of its duties. Such rules and regulations shall not be inconsistent with the laws of the State or the Charter or the ordinances of the City. Sec. 2 -87. Compensation. Members of the Industrial and Commercial Development Commission shall receive such compensation as may be provided by resolution of the City Council. Sec. 2 -88. Duties. The principal purpose of the Industrial and Commercial Development Commission is to advise the staff and City Council how best to seek and attract industry and commerce to the City. In that connection, the Commission shall have the following duties: (a) To identify any and all factors which tend to inhibit industrial and commercial development in the City and to report the same to the City Council; (b) To develop, adopt, and recommend to the Council for its adoption, positive promotional campaigns which would encourage industrial and commercial development, which campaigns may include slide presentations, promotional bro- chures, and other such devices by which the advantages of Cypress can be pre- sented to industrial and commercial concerns seeking to relocate; (c) To investigate and report to the City Council the methods by which a program to encourage industrial and commercial development can be funded, including any available federal and State grant programs; and (d) To perform such other studies and provide such other advice as may be requested from time to time by the City Council. SECTION 2. Severability. If any section, subsection, subdivision, sentence, clause, phrase, or portion of this ordinance, or the application thereof to any person or place, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance or its application to other persons or places. The City Council hereby declares that it would have adopted this ordinance, and each section, subsection, subdivision, sentence, clause, phrase or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions, or the application thereof to any person or place, be declared invalid or unconstitutional.
