ORDINANCE NO. 566
AN INTERIM URGENCY ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF CYPRESS PROHIBITING PUBLIC
STORAGE FACILITIES (MINI - WAREHOUSES) IN THE
COMMERCIAL HIGHWAY (CH)ZONE.
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY
DOES ORDAIN AS FOLLOWS:
SECTION 1. Any provision of the Zoning Ordinance of
the City of Cypress (including, but not limited to, Section
10.1[B][70] of said Ordinance) to the contrary notwithstand-
ing, no public storage facilities (mini- warehouses) shall be
permitted in the Commercial Highway (CH) Zone.
SECTION 2. The prohibition contained in Section 1
hereof shall not be construed to prohibit the construction
of public storage facilities for which a conditional use
permit has been previously authorized by the City over the past
six months.
SECTION 3. This ordinance is adopted as an urgency
interim ordinance pursuant to the provisions of Government
Code Section 65858 in order to protect the public safety,
health, and welfare. The City Council hereby finds that
the following facts require that this ordinance take effect
immediately:
The City staff, Planning Commission, and
City Council, have been and are now studying various
proposals for the implementation of recommendations
to enhance the Commercial Highway Zone as a retail
sales center. The construction of numerous public
storage facilities within said zone would eliminate
land otherwise available for retail sales activity
and would hinder the development of properties
within the Commercial Highway Zone as a retail
sales center.
SECTION 4. Severability.
If any section, subsection, subdivision, sentence,
clause, phrase, or portion of this ordinance, or the application
thereof to any person or place, is for any reason held to be
invalid or unconstitutional by the decision of any court of
competent jurisdiction, such decision shall not affect the
validity of the remaining portions of this ordinance or its
application to other persons or places. The City Council hereby
declares that it would have adopted this ordinance, and each
section, subsection, subdivision, sentence, clause, phrase
or portion thereof, irrespective of the fact that any one or
more sections, subsections, subdivisions, sentences, clauses,
phrases, or portions or the application thereof to any person
or place, be declared invalid or unconstitutional.
Introduced and adopted at a regular meeting of the
City Council of the City of Cypress held on the 26th day of
April, 1976.
