Ordinance No. 578ORDINANCE NO. 578 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS AMENDING SECTIONS 12 -6 AND 12 -7 OF THE CYPRESS CITY CODE RELATING TO THE COLLECTION OF GARBAGE, RUBBISH, AND WASTE MATERIAL. THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY DOES ORDAIN AS FOLLOWS: SECTION 1. Section 12 -6 of the Cypress City Code hereby is amended to read as follows: "Sec. 12 -6. Rates. (a) It is hereby found and determined that the periodic collection of garbage, rubbish and waste material from all places in the City benefits all occupants of places and premises in the City and that therefore all such occupants are made liable for the collection fees prescribed herein. (b) Occupants of single family dwellings shall be liable for a collection fee of $2.00 per month. With respect to those single family dwelling units which receive water service from the Southern California Water Company, said collection fee shall be due and payable at the same time and in the same manner as the fee charged for water service by said Company. With respect to those single family dwelling units which do not receive water service from said Company, the collection fee shall be due and payable to the City of Cypress on a quarterly basis, within fifteen (15) days following the close of each calendar quarter. (c) Occupants of premises other than single family dwelling units shall be liable for collection fees in such amounts as may from time to time be prescribed by resolution of garbage, rubbish, and waste material approved by the City Council. Where such col- lection is effected through a contract approved by the City Council, the liability imposed by this section shall be satisfied by payment of the collection fees to the person with whom the City contracts for such services." SECTION 2. Section 12 -7 of the Cypress City Code hereby is amended to read as follows: "Sec. 12 -7. Hours of Collection. The collection of garbage, rubbish, and waste material may commence not earlier than 6:00 o'clock a.m.; provided, however, that collections from industrial or commercial premises may be commenced earlier at any location at least 600 feet from a residence." SECTION 3. Severability. If any section, subsection, subdivision, sentence, clause, phrase, or portion of this ordinance, or the application thereof to any person or place, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance or its application to other persons or places. The City Council hereby declares that it would have adopted this ordinance, and each section, subsection, subdivision, sentence, clause, phrase or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions or the application thereof to any person or place, be declared invalid or unconstitutional. SECTION 4. Effective Date. This Ordinance shall take effect on October 1, 1976. FIRST READ at a regular meeting of the City Council of said City held. on the 9th day of August 1976,and finally adopted at a regular meeting of said City Council held on the 23rd day of August 1976.
