Ordinance No. 581/63 ORDINANCE NO. 581 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS, CALIFORNIA, ADDING CHAPTER 22 TO THE CODE OF THE CITY OF CYPRESS RELATING TO SEWERS AND SEWAGE DISPOSAL. THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY DOES ORDAIN AS FOLLOWS: SECTION 1. Chapter 22, entitled "Sewers and Sewage Disposal" hereby is added to the Code of the City of Cypress to read as follows: CHAPTER 22 SEWERS AND SEWAGE DISPOSAL Article I Sanitation and Sewerage System -- Charges Section 22 -1. Service -- Charges. The City furnishes to the residential, commercial, business and manufacturing community thereof, services and faci- lities in connection with its sanitation and sewerage system. In consideration of such services and facilities, the following charges hereby are established: (a) Residential. users -- $.50 per month for each single family dwelling and for each dwelling unit within a duplex or multiple family residential building; and, (b) Commercial and industrial users -- $.50 per month for the first two (2) water closets and $.25 per month for each water closet in excess of two (2), for each business, transportation, professional office, amusement, or other commercial or industrial user. Section 22 -2. Collection responsibilities. It shall be the duty of the Finance Director to collect all charges herein provided for. Section 22 -3. Manner of Billing and Collection. (a) With respect to all those users of the City's sanitation and sewerage system who receive water service from the Southern California Water Company, the charges established herein shall be due and payable at the same time and in the same manner as the fees charged for water service by said Company. (b) With respect to those users of the City's sanitation and sewerage system who do not receive water service from the Southern California Water Company, the Finance Director shall prepare and render a bill for the amount due, at least once every three (3) months, or on such more frequent basis that he shall determine appropriate in line of the fiscal requirements of the City. Said amount shall become due and payable upon rendering of the bill. The handing of the bill to such user in person, or the placing of the bill in an envelope or upon a postal card addressed to the user at the street address of his residence or business and mailing the same, postage prepaid, shall consti- tute "rendering a bill." Neither the non - receipt of any bill nor its mis- placement, loss or destruction before payment shall constitute a basis for any extension of time in which to make payment thereof. Such bills shall be payable at the office of the Finance Director in the City Hall at 5275 Orange Avenue, Cypress, California 90630. Section 22 -4. Failure to Pay Charges. In the event any bill is not paid within forty -five (45) days after the rendering thereof, there shall be added to the amount otherwise due and payable a penalty in an amount equivalent to ten percent (10 %) of said amount otherwise due and payable. Thereafter, for each additional period of thirty (30) days during which a delinquent account remains payable, there shall be added to the amounts otherwise payable (in- cluding the aforesaid penalty) an additional penalty equal to one -half (1/2) of one percent (1 %) of said amount otherwise payable. /6V In the event that any person shall fail to pay any charge herein provided when the same becomes due, the City may, in addition to any other remedies available to it, cut off any of said services and facilities referred to in this chapter, and need not resume the same until all delinquent charges and penalties, together with any charges necessitated by the resumption of such services and facilities, have been fully paid. As a condition precedent to the resumption of such services and facilities, the City may require the payment of a deposit of up to twice the estimated charges for a quarter. Section 22 -5. Charges for Non - Residents. Where the City furnishes to non - residents, or to businesses located outside its boundaries, services and facilities in connection with its sanitation and sewerage system, the charges for such services and facilities are hereby fixed at double those made for furnishing said services and facilities to residents, as provided for hereinabove. Section 22 -6. Sanitation Fund Created. There is hereby created a fund which shall be known as the Sanitation Fund. All moneys collected pursuant to the charges herein fixed shall be placed in said Fund. Said Fund shall be used only for such purposes as are permitted by law. SECTION 2. Severability. If any section, subsection, subdivision, sentence, clause, phrase, or portion of this ordinance, or the application thereof to any person or place, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance or its application to other persons or places. The City Council hereby declares that it would have adopted this ordinance, and each section, subsection, subdivision, sentence, clause, phrase or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentence, clauses, phrases, or portions, or the application thereof to any person or place, be declared invalid or unconstitutional. SECTION 3. Effective Date. This Ordinance shall take effect on October 1, 1976.
