ORDINANCE NO. 584
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS
AMENDING ORDINANCE NO. 559, THE ZONING ORDINANCE OF SAID
CITY, AND SPECIFICALLY SECTIONS 8, 15.1 , 15.3 AND 16.8 D
THEREOF, RELATING TO THE CONSTRUCTION, MAINTENANCE AND
AMORTIZATION OF SIGNS.
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY DOES ORDAIN AS FOLLOWS:
SECTION 1. Section 8 of Ordinance No. 559 hereby is amended to add
thereto the following definitions:
BILLBOARD shall mean any outdoor advertising display generally used for
the advertisement of goods produced or services rendered at a location or
locations other than the premises on which said display is located.
SECTION 2. Section 15.1 of Ordinance No. 559 hereby is amended by
changing subsection (N) thereof to read as follows:
N. Signs painted on the sides of buildings may be permitted to the
extent allowed in the various zones provided, however, that such signs shall
not cover more than 10% of the area of the side of the building on which the
sign is to be located, and provided, further, that all such signs shall be
subject to the review and approval of the Planning Commission in accordance
of the design review section of the Zoning Ordinance.
SECTION 3. Section 15.1 of Ordinance No. 559 hereby is further amended
by changing subsection (0) thereof to read as follows:
0. Signs shall not blink, flash, or be animated by lighting in any
fashion in any zone.
SECTION 4. Section 15.3 of Ordinance No. 559 hereby is amended by
adding thereto a subsection (G) to read as follows:
G. Billboards
Billboards may be permitted within the City of Cypress subject to
the following conditions and restrictions:
1. Billboards shall be permitted in the CH -10000 Zone only provided
that a conditional use permit therefore has been granted.
2. No new billboard shall be permitted within 300 feet of a residential
zone.
3. No new billboard shall be permitted within a 1500 foot radius of
of an existing billboard.
4. Billboards shall be placed on independent structures only, which
structures shall contain no more than two supports, and which
supports shall be of steel.
5. All billboards shall conform to the following development standards:
a. Maximum height - 30 feet
b. Maximum area - 300 square feet
c. Minimum ground clearance - 8 feet
d. No movement, blinking, flashing or animation of any kind.
e. No projection into or over any public right -of -way.
f. Minimum setback requirements for the CH -10000 Zone.
g. Lighting shall be by indirect source (shielded) provided
such lighting shall not exceed 800 milliamps rated capacity
or equivalent as determined by the Building Superintendent.
6. If any billboard is left blank or is maintained without copy
for a period of 60 days or more, such billboard shall be removed
within six months unless a conditional use permit is approved
for its re -use.
7. Any billboard which does not conform to the provisions of this
subsection shall be modified or removed in accordance with the
following provisions:
a. Billboards with an appraised value of less than $200
shall be brought into conformance or removed within
one (1) year of the effective date of this Ordinance
No. 584; or within such shorter period of time as may
be applicable thereto under the provisions of Section
16.8.
b. Billboards with an appraised value of more than $200
shall be brought into conformance within three (3)
years of the effective date of this Ordinance No. 584
or within such shorter period of time as may be
applicable thereto under the provisions of Section
16.8.
Appraised value of billboards shall be as determined by the
City Building Superintendent. Any such appraisal shall be
subject to review by the City Council if such review is
requested by the owner of such billboard or by the owner
of the property on which such billboard is situated.
8. If only one side of the structure is covered with advertising,
the back of the billboard shall be covered with suitable
material and maintained to the specifications of the City Code
and City staff.
9. Only one (1) billboard may be constructed on any one parcel of
land.
SECTION 5. Section 16.8 D of Ordinance No. 559 hereby is amended by
changing subsection (3) thereof to read as follows:
3. In any zone, elimination of non - conforming
lighting or movement. 6 months
SECTION 6. Section 16.8 D of Ordinance No. 559 hereby is further amended
by adding subsection (5) to read as follows:
5. In any zone, removal of signs which project
into or over public right -of -way. 1 year
SECTION 7. Severability.
The City Council of the City of Cypress hereby declares that should
any section, paragraph, sentence, or word of this Chapter of the Code, hereby
adopted, be declared for any reason to be invalid, it is the intent of the
Council that it would have passed all other portions of this Chapter independent
of the elimination herefrom of any such portion as may be declared invalid.
FIRST READ at a regular meeting of the City Council of said City held on
the 13th day of September 1976, and finally adopted and ordered posted at a
regular meeting of said Council held on the 27th day of September 1976.
